EUROPEAN COMMUNITIES (LICENSING OF DRIVERS) REGULATIONS, 1989.

The Minister for the Environment in exercise of the powers conferred on him by section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purpose of giving effect to Council Directive No. 80/1263/EEC hereby makes the following Regulations:—

1. These Regulations may be cited as the European Communities (Licensing of Drivers) Regulations, 1989.

2. A reference in the Road Traffic Acts, 1961 to 1984, to a class of mechanically propelled vehicles shall be construed as a reference to a class or category of such vehicles and cognate words and expressions shall be construed accordingly.

3. Notwithstanding section 33 (7) of the Road Traffic Act, 1961 (No. 24 of 1961), Regulations under section 42 of that Act may provide that the issuing authority for the purposes of section 33 of that Act shall not test or cause to be tested an applicant for a certificate of competency unless the applicant holds such driving licence or provisional licence as may be specified in the Regulations.

4. Regulations of the type referred to in Article 3 of these Regulations shall have effect in accordance with their terms and subsections (3) and (7) of section 33 and section 42 of the Road Traffic Act, 1961 are hereby amended accordingly.

5. These Regulations and the European Communities (Licensing of Drivers) Regulations, 1984 ( S.I. No. 234 of 1984 ) may be cited as the European Communities (Licensing of Drivers) Regulations, 1984 and 1989.

EXPLANATORY NOTE.

These Regulations provide for amendments to the Road Traffic Act, 1961 necessary for the introduction under the Road Traffic (Licensing of Drivers) Regulations, 1989 ( S.I. No. 285 of 1989 ) of a European Communities model driving licence in accordance with Council Directive 80/1263/EEC. They enable mechanically propelled vehicles to be divided into the categories set out in the Directive and also enable conditions to be applied in relation to persons who wish to undergo a driving test.
