WILDLIFE (WILD BIRDS) (OPEN SEASONS) (AMENDMENT) ORDER, 1989.

I, BRENDAN DALY, Minister of State at the Department of Finance, in exercise of the powers conferred on me by sections 8 and 24 of the Wildlife Act, 1976 (No. 39 of 1976), the Wildlife (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 156 of 1987 ), and the Finance (Delegation of Ministerial Functions) Order, 1989 ( S.I. No. 201 of 1989 ), hereby order as follows:

1. (1) This Order may be cited as the Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 1989.

(2) The Wildlife (Wild Birds) (Open Seasons) Orders, 1979 to 1986, and this Order may be cited together as the Wildlife (Wild Birds) (Open Seasons) Orders, 1979 to 1989.

2. In this Order "the Principal Order" means the Wildlife (Wild Birds) (Open Seasons) Order, 1979 ( S.I. No. 192 of 1979 ).

3. Notwithstanding anything in the Wildlife (Wild Birds) (Open Seasons) Order, 1979 ( S.I. No. 192 of 1979 ), as amended, the following species of protected wild bird, namely, the Greenland White fronted Goose, may be hunted in the county of Wexford from the 1st day of November, 1989, to the 1st day of January, 1990, both dates inclusive.

4. The first column of Part I (inserted by the Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 1986 ( S.I. No. 307 of 1986 )) of the First Schedule to the Principal Order is hereby amended by the deletion of the reference to the curlew.

5. Part I of the Second Schedule to the Principal Order is hereby amended by the addition, after paragraph 66 (inserted by the Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 1984 ( S.I. No. 283 of 1984 ) ), of the following paragraphs:

"67.Douglas Estuary in the County of Cork

The lands and waters forming the Douglas River estuary which are enclosed by an imaginary line drawn for a distance of 298.90 metres in a northwesterly-direction from the north western corner of the old railway bridge at the eastern extremity of the Douglas River along the western boundary of the embankment and continuing in the same direction along the western boundary of the disused railway line (now a pedestrian way) for a distance of 613 metres, thence in an imaginary straight line in a westerly direction to the south eastern corner of the .919 hectares field — a total distance of 277.55 metres continuing along the southern boundary of the .919 hectares field for 67.10 metres and along the southern boundary of the .221 hectare plot to its junction with the Bessboro Road a distance of 30.50 metres, thence along the western boundary of the Sacred Heart Home in a southerly direction 436.15 metres, thence westwards in an imaginary straight line for a distance of 451.40 metres to its junction with Bessboro Road, thence along the eastern boundary of Mahon Municapal Golf Course in a northern direction 155.55 metres to the south eastern boundary of Clover Hill House, thence in an imaginary straight line for 570.35 metres in a western direction to the northeastern corner of the .616 hectare field, thence southwestwards in an imaginary straight line for 591.70 metres to the junction of the eastern boundary of Greenbanks for 91.50 metres, thence southwestwards in an imaginary straight line for 97.60 metres to the northeastern end of the carriageway at Douglas Hall Lawn, thence along the eastern boundary of the Douglas Hall Lawn carriageway — a total length of 330.92 metres, thence continuing eastwards in an imaginary straight line for 176.90 metres to the shoreline, thence northeastwards in an imaginary straight line for 146.40 metres to the opposite shoreline, thence in another imaginary straight line to a point 45.75 metres from the northeastern corner of Orchard Villa, Rochestown Road, thence in a straight imaginary line to the point .61 metres southwards from the northwestern corner of Windsor, thence in a northern direction for 61 metres along the Douglas townland boundary of Windsor to its northwestern corner, thence in an eastern direction along the southern boundaries of the 1.247 hectare and 2,521 hectare fields and the eastern boundary of the 2 hectares field — a total distance of 335.50 metres, thence eastwards along the southern boundary of the 4.150 hectare field for 213.50 metres, thence in a southeasterly direction for 208.925 metres to the southwestern corner of the 2.450 hectare field, thence in an easterly direction along the southern boundaries of the 2.450 hectare, 1.331 hectares and 1.172 hectare fields — a total distance of 334.65 metres, thence southeastwards along the western boundary of the accessway to Bloomfield for a distance of 57.95 metres, thence southeastwards in an imaginary straight line to the northeastern corner of the .279 hectare plot at Monksfieldstown to the rere of dwellings on the north side of Rochestown Road — a total distance of 414.80 metres, thence undulating eastwards along the rere boundaries of the Rochestown Road dwellings for a total distance of 5.2460 metres, thence northwards along the Monksfieldstown townland boundary for 24.40 metres, thence eastwards along the southern boundary of Cork County Council sewage works for 112.85 metres, thence eastwards in an imaginary straight line for 96.075 metres, thence northwards along the eastern boundary of the sewage works for 88.450 metres and continuing further northwards in an imaginary straight line for 64.050 metres to its junction with the disused railway line (now a pedestrian way), thence finally continuing northwestwards along the western boundary of the said disused railway line for a distance of 334.65 metres to the first mentioned point at the northwestern corner of the old railway bridge on the eastern extremity of the Douglas River.

68. Inagh River (part) in the County of Clare

The lands and waters in the county of Clare which are enclosed by an imaginary line drawn from Grovemount House entrance gate at Bench Mark 62 on the Ennistymon/Lahinch road in a south westerly direction, along the centre of that road for a distance of 2,500 metres to the point where a fence meets that road on its northern side, approximately 30 metres to the west of Bench mark 63, thence in a northerly direction along the fence to the point where that fence meets a drain, thence eastwards along that drain for 20 metres, thence in a northerly direction along the fence that forms the eastern boundary of the Caravan Park and Lahinch Golf Links for a distance of 1,750 metres to the point where that fence meets the Lahinch/Liscannor road at O'Brien's Bridge, thence in a northerly, direction along the eastern wall of O'Brien's Bridge, thence in a northerly, direction along the eastern wall of O'Brien's Bridge for 60 metres to the point where that wall meets Ballyellery townland boundary near Bench Mark 36.2, thence in a northeasterly direction along that townland boundary for 760 metres to the point where that boundary reaches the centre of the road 200 metres to the north east of Bench Mark 16.2, thence in a north easterly direction along the centre of that road for 1,310 metres to Bench Mark 21, thence in a south easterly direction along the centre of the new bridge to Ennistymon Road, for 2,670 metres to the centre of the stream flowing under Knockbrack bridge (East), thence along the centre of that stream for 760 metres to the point where that stream meets the Inagh river, thence in a southerly direction for 380 metres along the fence leading to Government House to the point first mentioned at Bench Mark 62.".

EXPLANATORY NOTE.

The effect of the Order is to remove the Curlew from the Open Seasons list and to include the hunting of the Greenland White-fronted Goose in the County of Wexford only from the 1st day of November 1989, to the 1st day of January, 1990 both dates inclusive.

Its effect is also to include new areas excluded from the effects of the Open Season.
