THE EUROPEAN COMMUNITIES (SCHEDULED AIR FARES) REGULATIONS, 1989.

I, SEAMUS BRENNAN, Minister for Tourism and Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 87/601/EEC of 14 December, 1987(1), hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Scheduled Air Fares) Regulations, 1989, and shall be deemed to have come into operation on the 1st day of January, 1988.

2. In these Regulations:

"the Act" means the Air Transport Act, 1986 (No. 4 of 1986);

"the Council Directive" means Council Directive No. 87/601/EEC of 14 December, 1987(1);

"the Minister" means the Minister for Tourism and Transport.

3. A word or expression that is used in these Regulations and is also used in the Council Directive has, unless the contrary intention appears, the same meaning in these Regulations as it has in the Council Directive.

4. The criteria and procedures for determining air fares in respect of scheduled air services between the State and other Member States shall be those contained in the Council Directive and in section 3 of the Act.

5. The form prescribed for the submission of fares in accordance with Article 4 of the Directive shall be that provided for in the Act.

6. In the event of a dispute arising between the Minister and another Member State in regard to the non approval of a fare, the matter shall be settled in accordance with the consultation and arbitration provisions of the Directive.

EXPLANATORY NOTE.

The purpose of these Regulations is to implement Council Directive No. 87/601/EEC which lays down criteria and procedures for the approval of fares for scheduled air services between Member States.
