POSTAL AND TELECOMMUNICATIONS SERVICES ACT, 1983 (SECTION 111 (1))ORDER, 1989

I, RAPHAEL P. BURKE, Minister for Communications, being of opinion that the grant of a licence in accordance with the following Order is in the public interest and is consistent with the reasons given in subsection (2) of section 87 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), for the grant of the exclusive privilege referred to in subsection (1) of that section to Bord Telecom Éireann, hereby, in exercise of the powers conferred on me by section 111 (1) (a) of that Act and section 3 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), with the consent of the Minister for Finance and after consultation with Bord Telecom Éireann, order as follows:

1. This Order may be cited as the Postal and Telecommunications Services Act, 1983 (Section 111 (1)) Order, 1989.

2. The Minister for Communications may grant a licence to An Post to provide the telecommunications service specified in Article 3 of this Order subject to such terms and conditions as he may think fit to impose.

3. The telecommunications service to which Article 2 of this Order relates shall be in respect of and shall be limited to—

( a ) the receipt and collection of messages from the public (other than voice messages) by An Post—

(i) in a legible form, or

(ii) by electronic means over such part of the national telecommunications network of Bord Telecom Éireann as is provided for in the licence (referred to subsequently in this Article as "the network"),

and

( b ) the transmission of the messages by An Post by electronic means over the network, and

( c ) the delivery of the messages by An Post to the persons to whom they are addressed—

(i) in a legible form by the national postal service, or

(ii) by electronic means over the network.

EXPLANATORY NOTE.

The effect of this Order is to enable the Minister for Communications to license An Post for the provision of a public national telecommunications mail service.
