MERCHANDISE MARKS (PREPACKED GOODS) (MARKING AND QUANTITIES) (AMENDMENT) ORDER, 1989.

I, RAY BURKE, Minister for Industry and Commerce, after consultation with such persons as appear to me to be substantially interested in the general subject matter of the Order following and after compliance with subsection (10) of section 2 of the Merchandise Marks Act, 1970 (No. 10 of 1970), hereby, in exercise of the powers conferred on me by the said section 2, order as follows:

1. This Order may be cited as the Merchandise Marks (Prepacked Goods) (Marking and Quantities) (Amendment) Order, 1989.

2. This Order shall come into operation on the 1st day of January, 1990.

3. In this Order, the "Principal Order" means the Merchandise Marks (Prepacked Goods) (Marking and Quantities) Order, 1973 ( S.I. No. 28 of 1973 ).

4. The Principal Order is hereby amended by the insertion in column (1) of Part I of the First Schedule thereto of "knitting yarns (being yarns consisting of natural fibres (animal, vegetable and mineral), chemical fibres and mixtures thereof)" after "frozen vegetables" (inserted by the Merchandise Marks (Prepacked Goods) (Marking and Quantities) (Amendment) Order, 1986 ( S.I. No. 100 of 1986 )).

5. The Principal Order shall, insofar as it applies to knitting yarns of the kind specified in Part I of the First Schedule thereto (as inserted by Article 4 of this Order), have effect as if the following were substituted for the matter in column (2) of that Schedule:

"10 grams

100 grams

150 grams

200 grams

250 grams

300 grams

350 grams

400 grams

450 grams

500 grams

1 kilogram

These values are the anhydrous mass of the yarn to which the conventional humidity allowance laid down by Directive 71/307/EEC 1 is applied".

6. (1) The reference in Article 8 (1) (a) of the Principal Order to 14 grams shall be construed for the purposes of this Order as a reference to 10 grams.

(2) The reference in Article 8 (2) (a) of the Principal Order to 50 grams shall be construed for the purposes of this Order as a reference to 10 grams.

EXPLANATORY NOTE.

This Order amends the Merchandise Marks (Prepacked Goods) (Marking and Quantities) Order, 1973 (as amended) so as to prescribe the sizes in which knitting yarns may be sold with effect from 1st January, 1990. In so doing, it implements the provisions of Council Directive No. 87/356/EEC2 amending Council Directive No. 80/232/EEC3 on the approximation of the laws of the Member States relating to the ranges of nominal quantities and nominal capacities permitted for certain pre-packaged products.
