SOCIAL WELFARE (MODIFICATIONS OF INSURANCE) (AMENDMENT) REGULATIONS, 1988.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 and 7 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981) hereby makes the following Regulations:—

1. These Regulations may be cited as the Social Welfare (Modifications of Insurance) (Amendment) Regulations, 1988.

2. Article 7 of the Social Welfare (Modifications of Insurance) Regulations, 1979 ( S.I. No. 87 of 1979 ) is hereby amended by the substitution for sub-article (1) (j) of the following sub-article:—

"( j ) employment as a registered medical practitioner within the meaning of the Medical Practitioners Act, 1978 , where the person is pensionable under the Voluntary Hospitals' Superannuation Scheme, 1969, the Nominated Health Agencies' Superannuation Scheme, 1981, the Local Government (Superannuation) Act, 1956 (Consolidation Scheme) 1987 ( S.I. No. 316 of 1987 ), or the Local Government (Superannuation Revision) (Consolidation) Scheme, 1986 ( S.I. No. 391 of 1986 ), or employment in voluntary hospitals where the person is pensionable under the Voluntary Hospitals' Superannuation Scheme, 1969 and is employed in a permanent capacity and the terms and conditions of his employment provide for payments during illness on a basis which is considered adequate by the Minister.".

EXPLANATORY NOTE.

The Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1988 ( S.I. No. 58 of 1988 ) provided for the extension of social insurance cover to certain categories of employees previously excluded from the social insurance system, i.e. registered doctors or dentists, ministers of religion and certain employees of local and public authorities employed under a contract of service.

The extent of the social insurance cover for such employees is determined by the nature of their employment. These Regulations provide that medical practitioners covered by public sector superannuation schemes will be insurable at the Class D rate of PRSI. Class D insurance provides cover for widow's and orphan's (contributory) pensions, deserted wife's benefit and occupational injuries benefits.
