ROAD TRANSPORT ACTS (FEES) REGULATIONS, 1988.

I, JOHN P. WILSON, Minister for Tourism and Transport, in exercise of the powers conferred on me by section 6 of the Road Transport Act, 1933 (No. 8 of 1933), section 6 of the Road Transport Act, 1971 (No. 8 of 1971), section 10 of the Road Transport Act, 1986 (No. 16 of 1986), and the Communications (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1987 ( S.I. No. 92 of 1987 ), with the sanction of the Minister for Finance, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Road Transport Acts (Fees) Regulations, 1988.

(2) The Road Transport Acts Regulations, 1933 to 1986, and these Regulations may be cited as the Road Transport Acts Regulations, 1933 to 1988.

2. The Road Transport Act, 1933 Regulations, 1955 ( S.I. No. 69 of 1955 ), are hereby amended by the substitution for the First Schedule (inserted by the Road Transport Acts (Fees) Regulations, 1986 ( S.I. No. 312 of 1986 )) thereto of the following Schedule:—

"FIRST SCHEDULE

FEES

(1) Merchandise Licences being National Road Freight Carrier's Licences or International Road Freight Carrier's Licences

(a) On an application for the grant of a licence under section 3 (1) of the Road Transport Act, 1986 , a fee of

£40

together with, in respect of each vehicle to be specified in the licence a fee of

£30

(b) On an application for the grant of a licence under section 3 (6) of the Road Transport Act, 1986 , a fee of

£50

together with in respect of each vehicle to be specified in the licence a fee of

£40

(c) an application, during the period of validity of a licence, in respect of an additional vehicle to be specified in the licence, a fee, in respect of each period of 3 months or less of the unexpired period of the licence, of

£3

provided always that the minimum fee payable under this paragraph shall be a fee of

£5

(d) On an application, during the period of validity of a licence, for the substitution for a vehicle specified in the licence of another vehicle, a fee of

£5

(2) Merchandise Licences not being National Road Freight Carrier's Licences or International Road Freight Carrier's Licences

(a) On an application for a licence, a fee of ... ... ...

(b) On an application for the renewal of a licence, a fee of

£20

(c) On an application for the transfer of a licence, a fee of

£40

(3) Vehicle Plates

(a) On an application for a vehicle plate, a fee of

£20

(b) On an application for the issue of a vehicle plate by way of replacement, a fee of

£20

(c) On an application for a vehicle plate if the conditions set out in Regulation 4 (2) of the Road Transport Act, 1933 , Regulations, 1955 ( S.I. No. 69 of 1955 ) are complied with, a fee of

£2".

3. The Road Transport Acts (Fees) Regulations, 1977 ( S.I. No. 256 of 1977 ), are hereby amended by the substitution for Regulations 2 and 3 (inserted by the Road Transport Acts (Fees) Regulations, 1986) thereof of the following Regulations:—

"2. The fee payable for inspection of the registers established under—

(a) section 6 of the Road Transport Act, 1971 (No. 8 of 1971), and

(b) section 10 of the Road Transport Act, 1986 (No. 16 of 1986), shall be a fee of £3 per hour or part thereof.

3. The fee payable for a copy of an entry in the registers established under—

(a) section 6 of the Road Transport Act, 1971 , and

(b) section 10 of the Road Transport Act, 1986 ,

shall be a fee of £5.".

4. The Road Transport Acts (Fees) Regulations, 1986, are hereby revoked.

EXPLANATORY NOTE.

The effect of the Instrument is to prescribe fees on application for the grant of national/international Road Freight Carrier's Licences under both the first and second phases of the Road Transport Act, 1986 , for the issue, renewal and transfer of Merchandise Licences, for the issue of vehicle plates, for inspection of the registers of Merchandise Licences and national/international Road Freight Carrier's Licences and for a copy of an entry in the said registers.
