DISTRICT COURT (MALICIOUS INJURIES) RULES, 1987.

The District Court Rules Committee, in exercise of the powers conferred on them by section 91 of the Courts of Justice Act, 1924 , section 72 of the Courts of Justice Act, 1936 , section 17 of the Interpretation Act, 1937 (as applied by section 48 of the Courts (Supplemental Provisions) Act, 1961 ), and section 34 of the Courts (Supplemental Provisions) Act, 1961 , do hereby, with the concurrence of the Minister for Justice, make the following rules of Court:—

1. These Rules may be cited as the District Court (Malicious Injuries) Rules, 1987.

2. These Rules shall come into operation on the 10th day of August, 1987 and shall be read together with all other District Court Rules for the time being in force.

3. In these Rules—

"the Rules of 1982" means the District Court ( Malicious Injuries Act, 1981 ) Rules, 1982 ( S.I. No. 149 of 1982 ).

4. There shall be inserted in Rule 3 of the Rules of 1982 immediately after the definition of "the Act" the following two definitions:—

"the Act of 1986" means the Malicious Injuries (Amendment) Act, 1986 (No. 27 of 1986); and "the Acts" means the Malicious Injuries Acts 1981 and 1986.

5. Notwithstanding the provisions of the Rules of 1982 and Forms 1 to 10 (inclusive) set out in the schedule to those Rules, Forms 1 to 10 (inclusive) set out in the schedule hereto shall respectively be the appropriate forms of Notice of Application for, and Decree awarding compensation under the Acts for damage or loss caused on or after the 15th day of July, 1986.

These Rules, which come into operation on 10 August, 1987, prescribe revised District Court forms of notice of Application for and Decree awarding compensation under the Malicious Injuries Act, 1981 as amended by the Malicious Injuries (Amendment) Act, 1986 in respect of damage or loss caused on or after 15 July 1986.
