SEA FISHERIES (CONSERVATION AND RATIONAL EXPLOITATION) (AMENDMENT) ORDER, 1987.

I, PADDY O`TOOLE, Minister for Tourism, Fisheries and Forestry, in exercise of the powers conferred on me by section 223A (inserted by section 9 of the Fisheries (Amendment) Act, 1978 (No. 18 of 1978), and amended by section 4 of the Fisheries (Amendment) Act, 1983 (No. 27 of 1983)), of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1986 ( S.I. No. 40 of 1986 )), hereby order as follows:

1. This Order may be cited as the Sea Fisheries (Conservation and Rational Exploitation) (Amendment) Order, 1987.

2. The Sea Fisheries (Conservation and Rational Exploitation) Order, 1987 ( S.I. No. 2 of 1987 ), is hereby amended by the substitution for Article 2 of the following Article:

"2. In this Order "the Council Regulation" means Council Regulation (E.E.C.) No. 3094/86 of 7 October, 19861, as amended by Council Regulation (E.E.C.) No. 4026/86 of 18 December, 19862, (aa) and by any regulation of the Council made after the making of this Order which amends the said Council Regulation (E.E.C.) No. 3094/86."

EXPLANATORY NOTE.

The effect of this Order is to prescribe and adopt Council Regulation (EEC) 4026/86 of 18 December, 1986 which, in so far as Ireland is concerned, permits the continued use of nets with a minimum mesh size of 80mm south of the parallel of 56N.
