AQUACULTURE (CLARE ISLAND) ORDER, 1987.

I, PADDY O'TOOLE, Minister for Tourism, Fisheries and Forestry, in exercise of the powers conferred on me by section 54 of the Fisheries Act, 1980 (No. 1 of 1980), as amended by section 5 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and by the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1986 ( S.I. No. 40 of 1986 )), having complied with the requirements of subsection (3) of the said section 54, and having considered a report made to me under subsection (4) of the said section 54, and being of the opinion that, notwithstanding the existence of any public right to fish in the waters to which the following order relates, it is in the public interest that the order be made, hereby with the consent of the Minister for Communications, order as follows:

1. This Order may be cited as the Aquaculture (Clare Island) Order, 1987.

2. The area described in the Schedule hereto is hereby designated to be an area within which it shall be lawful to engage in aquaculture pursuant to and in accordance with a licence granted under section 54 of the Fisheries Act, 1980 (No. 1 of 1980).

SCHEDULE

All that area of sea adjoining Clare Island which is enclosed by an imaginary line commencing at the most easterly point of the high water mark of the townland of Capnagower, barony of Murrisk, county of Mayo and continuing due north for a distance of 750 metres, thence continuing at a bearing of 315° true for a distance of 1,400 metres and thence continuing at a bearing of 166° true to where it meets the high water mark of the townland of Lecarrow, barony of Murrisk, county of Mayo and finally continuing along the last mentioned high water mark initially in a south easterly direction to the point first mentioned.

EXPLANATORY NOTE.
