HARBOUR RATES (WICKLOW HARBOUR) ORDER, 1986.

I, TED NEALON, Minister of State at the Department of Communications, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and the Communications (Delegation of Ministerial Functions) Order, 1984 ( S.I. No. 140 of 1984 ), and after due compliance with section 106 of the said Harbours Act, 1946 , hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Wicklow Harbour) Order, 1986.

(2) This Order shall come into operation on the 1st day of February, 1987.

2. In this Order "the Order of 1985" means the Harbour Rates (Wicklow Harbour) Order, 1985 ( S.I. No. 97 of 1985 ).

3. (1) The Harbour Rates (Wicklow Harbour) Order, 1949 ( S.I. No. 172 of 1949 ), is hereby amended by—

(a) the substitution for the First Schedule (inserted by the Order of 1985) thereto of the following Schedule:

On every ton of the net register tonnage or half the gross tonnage, whichever is the greater, of every vessel entering the harbour:

Rates on fishing vessels:

(a)

As a composition in full in lieu of tonnage rates on every fishing vessel entering the harbour for the purpose of landing fish, per year:

(b)

On every fishing vessel entering the harbour for any purpose other than landing fish, for each entry:

£5.00

The rate at 2 (b) is chargeable for each stay in the harbour of seven days of part thereof.

3.

Rates on Pleasure Boats:

(a) (i)

On every open pleasure boat of 1 ton gross or under, not being a pleasure boat described in Clause (ii) of this subparagraph, as a composition in full in lieu of tonnage rates payable yearly inadvance, a sum not exceeding:

(ii)

On every open pleasure boat of 1 ton gross or under with cuddy or cabin not exceeding six feet in length as a composition in full in lieu of tonnage rates payable yearly in advance, a sum not exceeding:

(b) (i)

On every decked or part decked pleasure boat of 1.5 tons gross or under, being neither a catamaran not a trimaran, as a composition in full in lieu of tonnage rates payable half-yearly in advance, for the period—

(1) 15th April — 14th October, a sum not exceeding

(2) 15th October — 14th April, a sum not exceeding

(ii)

On every catamaran or trimaran of 1.5 tons gross or under as a composition in full lieu of tonnage rates payable half-yearly in advance, for the period—

And for every 7 days or part thereof over 21 days a further:

(2) Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows:

(a) any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes,

(b) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes,

(c) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall count as 750 kilogrammes,

(d) any weight exceeding 750 kilogrammes but not exceeding 1 tonne shall count as 1 tonne.

4. The Harbour Rates (Wicklow Harbour) Order, 1985 ( S.I. No. 97 of 1985 ), is hereby revoked.

EXPLANATORY NOTE.

This Order authorities the Wicklow Harbour Commissioners to charge revised goods, tonnage and other charges at Wicklow Harbour.
