CONTROL OF BULLS FOR BREEDING (PERMITS) REGULATIONS, 1986.

I, AUSTIN DEASY, Minister for Agriculture, in exercise of the powers conferred on me by sections 3 and 11 of the Control of Bulls for Breeding Act, 1985 (No. 13 of 1985), hereby make the following Regulations:

1. These Regulations may be cited as the Control of Bulls for Breeding (Permits) Regulations, 1986.

2. These Regulations shall come into operation on the 1st day of November, 1986.

3. In these Regulations—

"bull beef production enterprise" means a person who keeps and fattens off a bull for the purpose of bull beef production and not for the purpose of breeding;

"research organisation" means An Foras Talúntais, a college of third level education which carries out a research programme into the breeding of bulls, or other body involved in scientific research requiring the use of bulls;

"small herd" means a herd of not more than 20 cows or breeding heifers owned by a person who does not engage wholly or partly in the production of milk for public sale.

4. The Minister may grant a permit to have possession of an unregistered bull to—

(a) a research organisation, or

(b) a bull beef production enterprise, or

(c) a person in respect of the use of the bull for breeding in a small herd, or

(d) a person in respect of a bull which is entered or eligible to be entered in a herd book maintained by an organisation which is not an approved organisation.

5. (a) Every application for a permit under these Regulations shall be addressed to the Secretary, Department of Agriculture, Agriculture House, Dublin 2 and shall be accompanied by—

(i) a fee of £5 in the case of a permit applied for by a person referred to in paragraphs (a), (b) and (d) of Regulation 4 of these Regulations, or

(ii) a fee of £30 in the case of a permit applied for by a person referred to in paragraph (c) of Regulation 4 of these Regulations, except where in such a case the Minister appoints a place under Regulation 6(b) (ii) of these Regulations, when the fee shall be £15.

(b) Whenever the Minister receives an application for a permit pursuant to these Regulations, the Minister may, if he feels that it is necessary or desirable so to do, before considering the application, request the applicant to provide such additional information as may be specified in the request, and the Minister shall not further consider the application until the applicant has furnished any information so requested.

6. (a) Whenever a person referred to in Regulation 4(c) of these Regulations applies for a permit, the permit shall not issue until the bull concerned has been inspected by an inspector.

(b) The inspection of a bull pursuant to paragraph (a) of this Regulation may be carried out—

(i) at the place where the bull is normally kept, or

(ii) if the Minister considers it appropriate, at such other place as he may appoint.

7. Every permit granted pursuant to Regulation 4(c) of these Regulations shall, if such permit has not previously expired, cease to have effect on the 31st day of October 1989.

8. Whenever a person referred to in Regulation 4(d) of these Regulations applies for a permit, the following provisions shall apply—

(a) a permit shall not be issued unless the Minister is satisfied that the programme for breed improvement organised, and the registration procedures operated, by the organisation concerned are of an acceptable standard,

(b) the permit shall be revoked if the bull in respect of which the permit is sought, is not registered in the herd book maintained by the organisation concerned by the time such bull attains the age of 15 months.

9. Whenever the Minister issues a permit under these Regulations, he may attach to the permit such conditions as seem to him appropriate having regard to all the circumstances of the case.

10. If any condition attached to a permit under these Regulations is not complied with, the Minister, if he considers it desirable so to do, may revoke or suspend the permit.

EXPLANATORY NOTE.

These Regulations prescribe the circumstances and fees for granting permits authorising persons to have in their possession unregistered bulls.
