DISABLED PERSONS (MAINTENANCE ALLOWANCES) (AMENDMENT) REGULATIONS, 1986.

The Minister for Health, in exercise of the powers conferred on him by section 5 of the Health Act, 1947 (No. 28 of 1947), and by sections 69 and 72 of the Health Act, 1970 (No. 1 of 1970) hereby makes the following Regulations:

(1) (a) These Regulations may be cited as the Disabled Persons (Maintenance Allowances) (Amendment) Regulations, 1986.

(b) These Regulations and the Disabled Persons (Maintenance Allowances) Regulations, 1984 ( S.I. No. 71 of 1984 ) shall be construed as one and may be cited together as the Disabled Persons (Maintenance Allowances) Regulations, 1984 and 1986.

(2) These Regulations shall come into operation on the 17th day of July, 1986.

(3) With effect from the commencement of these Regulations, a maintenance allowance payable to a person in accordance with article 3 of the Disabled Persons (Maintenance Allowances) Regulations, 1984 shall be a weekly allowance not exceeding the personal rate of the allowance specified in the Schedule to these Regulations and increases for dependants not exceeding the amounts specified in the said Schedule as may be appropriate.

(4) The Disabled Persons (Maintenance Allowances) (Amendment) Regulations, 1985 ( S.I. No. 190 of 1985 ) shall be revoked as from the commencement of these Regulations.

EXPLANATORY NOTE.

The effect of these Regulations is to amend the scheme of maintenance allowances payable under section 69 of the Health Act, 1970 , by providing as from 17th July, 1986 for an increase in the maximum weekly rate for eligible applicants to forty three pounds and twenty pence and by providing for increases for dependants aged over eighteen years.
