ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF TIPPERARY) (NORTH RIDING) REGULATIONS, 1986.

The Minister for the Environment in exercise of the powers conferred on him by section 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Tipperary North Riding) Regulations, 1986.

2 Commencement.

2. These Regulations shall come into operation on the 23rd day of June, 1986.

3 Interpretation.

3. In these Regulations save where the context otherwise requires

"the Act" means the Road Traffic Act, 1961 ;

"distance" means distance as measured along the centre line of a road;

"national road" means a road declared to be a national road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road as shown in column 1 of the First Schedule or column 1 of the Second Schedule to the aforementioned Order;

"perimeter road" means a road on and along the roadway of which there runs the boundary of an urban district;

"road" means a public road;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. These shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. The Road Traffic (Speed Limits) (County of Tipperary North Riding) Regulations, 1977 ( S.I. No. 176 of 1981 ) are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act. 1961.

1. The following roads in the Urban District of Nenagh:—

( a ) The Moyroe Road, The Cloughjordan Road.

( b ) The Limerick Road (National Road N7) for a distance of 1,051 metres from the urban district boundary.

( c ) The Dublin Road (National Road N7)' between the urban district boundary and a point 22 metres east of its junction with the Old Well Road.

( d ) The Portroe Road between the urban district boundary and a point 185 metres north-west of its junction with the Cudville Road.

( e ) The Borrisokane Road (National Road N52) between the urban district boundary and a point 252 metres North-west of its junction with Ellard's Lane or St. Joseph's Park.

( f ) The Old Birr Road for a distance of 512 metres from the urban district boundary.

( g ) The Thurles Road for a distance of 137 metres from the urban district boundary.

( h ) The Dolla Road for a distance of 818 metres from the point where the urban district boundary intersects the north-western side of the road.

( i ) The Ballintogher Road between a point where the urban district boundary intersects the north-western side of the road and its junction with the Nenagh-Dolla Road.

2. The following roads in the Urban District of Templemore:

( a ) The Thurles Road (National Road N62), The Ivy Hall Road.

( b ) The Clonmore-Templetuohy road for a distance of 950 metres from the point where the urban district boundary intersects the south-western side of the road.

( c ) The Roscrea Road (National Road N62) for a distance of 214 metres from the urban district boundary.

( d ) The Dunkerrin Road between the urban district boundary and a point 90 metres north-west of its junction with Richmond.

( e ) Richmond and its continuation as the Borrisoleigh Road between the urban district boundary and a point 10 metres north-east of the junction of the Thurles Road (National Road N62) with the Borrisoleigh Road.M

( f ) The Wellington Lodge Road for a distance of 90 metres from its junction with the Thurles Road.

( g ) The Woodville Road between the urban district boundary and a point 228 metres south-east of its junction with the Back Road.

( h ) The Cloone Road for a distance of 940 metres from the urban district boundary.

3. The following roads in the Urban District of Thurles:—

( a ) The Lewagh Road between the point where the urban district boundary intersects the north-eastern side of the road and a point 182 metres north of its junction with the Limerick Road.

( b ) The Ladywell or Littleton Road between the urban district boundary and a point 45 metres south of its junction with the Dublin Road (National Road N75).

( c ) The Moyne Road between the urban district boundary and a point 182 metres north-east of its junction with Sean Treacy Avenue.

( d ) The Templemore Road (National Road N62) for a distance of 660 metres from the point where the urban district boundary intersects the eastern side of the road.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ballina:

( a ) The Portroe-Birdhill road between a point 746 metres north of its junction with the Grange Road and a point 30 metres south of its junction with the Boher Road.

( b ) The Grange (or Ball Alley) Road for a distance of 400 metres from its junction with the Portroe-Birdhill road.

( c ) The Boher Road for a distance of 28 metres from its junction with the Portroe-Birdhill road.

( d ) The portion of Killaloe Bridge lying north-east of the boundary of the counties of Tipperary and Clare and the road connecting the said bridge with the Portroe-Birdhill road.

2. The following road at Ballingarry (Roscrea):—

The Borrisokane-Birr road (National Road N52) between a point 105 metres south-west of its junction with the Shinrone Road and a point 180 metres north-east of its junction with the road leading to Ballingarry Cemetery.

3. The following roads at Borrisokane:

( a ) Convent Road.

( b ) The Nenagh-Portumna road (National Road N65) between a point 920 metres south of its junction with the Cloughjordan Road and a point 385 metres north of its junction with the Ballingarry Road.

( c ) The Cloughjordan Road for a distance of 680 metres from its junction with the Nenagh-Portumna road (National Road N65).

( d ) The Finnoe Road for a distance of 670 metres from its junction with the Nenagh-Portumna road (National Road N65).

( e ) The Ballingarry Road (National Road N52) for a distance of 298 metres from its junction with the Nenagh-Portumna road (National Road N65).

( f ) The Ballinderry Road for a distance of 95 metres from its junction with the Nenagh.Portumna road (National Road N65).

4. The following roads at Borrisoleigh:—

( a ) The Nenagh-Thurles road between a point 92 metres north-west of its junction with the Ileigh Road and a point 183 metres south-east of its junction with the Templemore Road.

( b ) The Ileigh road for a distance of 46 metres from its junction with the Nenagh-Thurles road.

( c ) The Pallas Road for a distance of 560 metres from its junction with the Nenagh-Thurles road.

( d ) The Templemore Road for a distance of 320 metres from its junction with the Nenagh-Thurles road.

5. The following roads at Dromineer:

( a ) The Nenagh Road for a distance of 260 metres from its junction with the Killaun Road.

( b ) The Killaun Road for a distance of 400 metres from its junction with the Nenagh Road.

6. The following roads at Holycross:

( a ) The Thurles Road between the boundary between the counties of Tipperary North Riding and Tipperary South Riding and a point 170 metres north-east of its junction with the Ballycahill Road.

( b ) The Ballycahill Road for a distance of 400 metres from its junction with the Thurles Road.

( c ) The Tipperary Road for a distance of 420 metres from its junction with the Thurles Road.

( d ) The road at the southern end of Fair Green connecting the Thurles Road with the Tipperary Road.

7. The following roads at Littleton:

( a ) The Ballybeg Road for a distance of 476 metres from its junction with the Dublin-Cork road (National Road N8).

( b ) The New Brimingham road for a distance of 92 metres from its junction with the Ballybeg Road.

( c ) The Thurles Road for a distance of 416 metres from its junction with the Dublin-Cork road (National Road N8).

( d ) The Ballymureen Bridge Road for a distance of 380 metres from its junction with the Dublin-Cork road (National Road N8).

8. The following road at Lorrha:—

The Carrigahorig-Ballincor road between a point 135 metres north-east of its junction with the Bredagh Road and a point 90 metres south-west of its junction with the road leading to the Franciscan Friary.

9. The following road adjacent to the Urban District of Nenagh:—

The Dromin Road for a distance of 20 metres from the boundary of the urban district of Nenagh.

10. The following roads at Newport:—

( a ) Gaol Road.

( b ) The Limerick-Thurles road between a point 416 metres south-west of its junction with the Ballinahinch Road and a point 366 metres east of its junction with the Killoscully Road.

( c ) The Ballinahinch Road for a distance of 458 metres from its junction with the Limerick-Thurles road.

( d ) The Killoscully road for a distance of 605 metres from its junction with the Limerick-Thurles road.

( e ) The Murrow Road for a distance of 175 metres from its junction with the Limerick-Thurles road.

11. The following roads at Newtown:

( a ) The Nenagh-Portroe road between a point 110 metres east of its junction with Mill Lane and a point 460 metres west of its junction with the Youghal Road.

( b ) The Youghal Road for a distance of 255 metres from its junction with the Nenagh-Portroe road.

12. The following road at Portroe:

The Nenagh-Ballina road between a point 5 metres south of its junction with the Coole Road and a point 140 metres north of its junction with the Garrykennedy Road.

13. The following roads at Puckane:

( a ) The Nenagh-Kilbarron road between a point 185 metres south of its junction with the Dromineer Road and a point 245 metres north of the said junction.

( b ) The Dromineer Road for a distance of 555 metres from its junction with the Nenagh-Kilbarron road.

14. The following roads at Riverstown:—

( a ) The Borrisokane-Birr road (National Road N52) between the boundary between the counties of Offaly and Tipperary North Riding at Riverstown Bridge and a point 145 metres south-west of its junction with the Portumna road.

( b ) The Portumna Road for a distance of 95 metres from its junction with the Borrisokane-Birr road (National Road N52).

15. The following roads at Roscrea:

( a ) Abbey Street, Air Hill, Assumption Park, Ballyhall, Carroll's Row, Chapel Lane, Cnoc Mhuire, The Crescent, Gaol Road, Glebe View, The Mall, The New Line, River Lane. Rosemount.

( b ) The Dublin-Limerick road (National Road N7) between a point 92 metres east of its junction with the Short Corville Road and a point 150 metres south-west of its junction with the New Line.

( c ) The Tullamore-Templemore road (National Road N62) between a point 780 metres north of its junction with the Ashbury Road and a point 5 metres south of its junction with the Corville School Road.

( d ) The Knock Road for a distance of 202 metres from its junction with the Corville Road.

( e ) The Corville Road for a distance of 302 metres from its junction with the Knock Road.

( f ) The Ashbury Road between its junction with the Tullamore-Templemore road and a point 92 metres south-west of its junction with the Dungar Road.

( g ) The Golden Grove Road for a distance of 503 metres from its junction with the Tullamore-Templemore road.

( h ) The Birr Road for a distance of 503 metres from its junction with the Tullamore-Templemore road.

( i ) The Mountevideo Road for a distance of 202 metres from its junction with the Birr road.

( j ) The Shinrone Road for a distance of 92 metres from its junction with the Dublin-Limerick road (National Road N7).

( k ) Junction with the Tullamore-Templemore road.

( l ) The Short Corville Road for a distance of 165 metres from its junction with the Dublin-Limerick road (National Road N7).

16. The following roads at Silvermines:—

( a ) The Newport-Dolla road between a point 185 metres east of its junction with Main Street and a point 95 metres west of the said junction.

( b ) Main Street between its junction with the Ballinoe Road and its junction with the Newport-Dolla road.

( c ) The Nenagh Road for a distance of 200 metres from its junction with the Newport-Dolla road.

17. The following roads at Templederry:

( a ) The Dolla-Currabaha road between a point 480 metres east of its junction with the Latteragh-Greenane road and a point 265 metres west of the said junction.

( b ) The Latteragh-Greenane road between a point 65 metres north of its junction with the Dolla-Currabaha road and a point 130 metres south of the said junction.

18. The following roads at Templetuohy:

( a ) The Templemore-Johnstown road between a point 275 metres south-east of its junction with the Togher Road and a point 145 metres north-west of its junction with the Moyne Road.

( b ) The Moyne Road for a distance of 75 metres from its junction with the Templemore-Johnstown road.

( c ) The Togher Road for a distance of 275 metres from its junction with the Templemore-Johnstown road.

( d ) The road to Templetuohy Church.

19. The following roads adjacent to the Urban District of Thurles:

( a ) The Limerick Road for a distance of 295 metres from the point where the boundary of the urban district of Thurles intersects the western side of the road.

( b ) The Lewagh Road between its junction with the Limerick Road and a point 183 metres north of the said junction.

( c ) The Holycross Road where the said road is a perimeter road.

( d ) The Horse and Jockey Road (National Road N62) for a distance of 85 metres from the point where the boundary of the urban district of Thurles intersects the north-eastern side of the road.

( e ) The Two-Mile Borris Road (National Road N75) for a distance of 100 metres from the point where the boundary of the urban district of Thurles intersects the northern side of the road.

( f ) The Sugar Factory Road for a distance of 70 metres from the boundary of the urban district of Thurles.

( g ) The Loughmore Road (National Road N62) for a distance of 505 metres from the point where the boundary of the urban district of Thurles intersects the western side of the road.

20. The following roads at Toomevara:—

( a ) The Dublin-Limerick road (National Road N7) between a point 320 metres north-east of its junction with the Pallas Road and a point 60 metres west of its junction with the Silvermines Road.

( b ) The Blean Road for a distance of 165 metres eastwards from its junction with the Gortagarry Road.

( c ) The Gortagarry Road for a distance of 300 metres southwards from its junction with the Blean Road.

( d ) The road connecting the Blean Road and the Gortagarry Road with the Dublin-Limerick road (National Road N7).

THIRD SCHEDULE

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following road at Ardcroney:

The Nenagh-Borrisokane road (National Road N52) between a point 395 metres south-west of Ardcroney crossroads and a point 305 metres north-east of the said crossroads.

2. The following roads at Ballinderry:—

( a ) The Terryglass Road for a. distance of 360 metres from its junction with the Borrisokane Road.

( b ) The Coolbawn Road for a distance of 260 metres from its junction with the Kilbarron Road at River Bridge.

( c ) The Kilbarron Road for a distance of 90 metres from its junction with the Colbawn Road.

( d ) The Borrisokane Road for a distance of 120 metres from its junction with the Terryglass Road.

( e ) The Kylenoe Road for a distance of 90 metres from its junction with Terryglass Road.

3. The following roads at Ballycahill:—

( a ) The Thurles-Limerick road between a point 90 metres west of its junction with the Crossogue Road and a point 135 metres east of its junction with the Nenagh road.

( b ) The Crossogue Road for a distance of 55 metres from its junction with the Limerick-Thurles road.

( c ) The Holycross Road for a distance of 425 metres from its junction with the Limerick-Thurles road.

( d ) The Nenagh Road for a distance of 60 metres from its junction with the Limerick-Thurles road.

4. The following road at Ballycommon (Nenagh):

The Nenagh-Dromineer road between a point 245 metres south-east of Ballycommon crossroads and a point 130 metres north west of the said crossroads.

5. The following roads at Birdhill:—

( a ) The Nenagh-Limerick road (National Road N7) between a point 275 metres south-west of its junction with the Parteen Road and a point 250 metres south-west of its junction with the Ballina Road.

( b ) The Parteen Road for a distance of 45 metres from its junction with the Nenagh-Limerick road (National Road N7).

( c ) The Newport Road for a distance of 45 metres from its junction with the Nenagh-Limerick road (National Road N7).

6. The following roads at Bouladuff (Thurles):

( a ) The Thurles-Nenagh road between a point 120 metres south-east of its junction with the Ballycahill Road and a point 75 metres north of its junction with the Dovea-Annfield road.

( b ) The Ballycahill Road for a distance of 125 metres from its junction with the Thurles-Nenagh road.

( c ) The Annfield Road for a distance of 90 metres from its junction with the Thurles-Nenagh road.

( d ) The Dovea Road for a distance of 85 metres from its junction with the Thurles-Nenagh road.

7. The following road at Carrig (Birr):

The Borrisokane-Birr road (National Road N52) between a point 240 metres south-west of its junction with the Graigue Road and a point 285 metres north-east of the said junction.

8. The following roads at Cloughjordan:

( a ) Hospital Lane.

( b ) The Moneygall-Borrisokane road between a point 465 metres west of its junction with the Nenagh-Road and a point 165 metres south-east of its junction with the Errill Road.

( c ) The Nenagh Road for a distance of 320 metres from its junction with the Moneygall-Borrisokane road.

( d ) The Shinrone road for a distance of 155 metres from its junction with the Moneygall-Borrisokane road.

( e ) The Errill Road for a distance of 30 metres from its junction with the Moneygall Road.

9. The following roads at Drom:

( a ) The Rahealty Road for a distance of 250 metres from its junction with the Parochial Road.

( b ) The Parochial road for a distance of 390 metres from its junction with the Rahealty Road.

( c ) The Creamery Road for a distance of 335 metres from its junction with the Rahealty Road.

10. The following road at Horse & Jockey:—

The Dublin-Cork (National Road N8) between a point 100 metres north-east of its junction with the Thurles Road (National Road N62) and a point 100 metres south-west of the said junction.

11. The following road at Littleton:—

The Dublin-Cork road (National Road N8) between a point 260 metres north-east of its junction with the Thurles Road and a point 156 metres south-west of the said junction.

12. The following roads in and adjacent to the Urban District of Nenagh:

( a ) The Ballintogher Road between its junction with the Nenagh-Dolla road and a point 85 metres north-east of the point where the boundary of the urban district of Nenagh intersects the south-eastern side of the road.

( b ) The Dublin Road (National Road N7) between a point 22 metres east of its junction with the Old Well Road and a point 550 metres east of the said junction.

( c ) The Limerick Road (National Road N7) between a point 225 metres north-east of the boundary of the urban district of Nenagh and a point 1,051 metres north-east of the said boundary.

( d ) The Portroe Road between a point 185 metres north-west of its junction with the Cudville Road and a point 370 metres north-west of the boundary of the urban district of Nenagh.

( e ) The Dromineer Road for a distance of 480 metres from its junction with the Portroe Road.

( f ) The Dark Road for a distance of 55 metres from its junction with the Portroe Road.

( g ) The Dolla Road between a point 818 metres north-east of the point where the boundary of the urban district of Nenagh intersects the north-western side of the road and a point 145 metres north-east of the said intersection.

13. The following roads at Newport:

( a ) The Murroe Road between a point 175 metres south of its junction with the Limerick-Thurles road and a point 421 metres south of the said junction.

( b ) The Killoscully Road between a point 605 metres from its junction with the Limerick-Thurles road and a point 850 metres from the said junction.

14. The following road at Roscrea:

The Dublin Road (National Road N7) between a point 92 metres east of its junction with the Short Corville Road and a point 595 metres east of the said junction.

15. The following roads in and adjacent to the Urban District of Templemore:

( a ) The Roscrea Road (National Road N62) between a point 214 metres south of the boundary of the urban district of Templemore and a point 270 metres north of the said boundary.

( b ) Richmond and its continuation as the Borrisoleigh Road between a point 10 metres north-east of the junction of the Thurles Road (National Road N62) with the Borrisoleigh Road and a point 625 metres south-west of the said junction.

( c ) The Thurles Road (National Road N62) between its junction with the Borrisoleigh Road and a point 46 metres north of its junction with the Wellington Lodge Road.

( d ) The Clonmore-Templetuohy road between a point 950 metres from the point where the urban district boundary of Templemore intersects the south-western side of the road and a point 335 metres west of the junction of the Clonmore Road with the Templetuohy Road.

16. The following roads at Terryglass:

( a ) The Carrigahorig-Ballinderry road between a point 50 metres east of its junction with the Slevyre Road and a point 545 metres south-west of the bridge in Terryglass village.

( b ) The Gortmore Road for a distance of 760 metres from its junction with the Carrigahorig-Ballinderry road.

( c ) The Crossannagh Road for a distance of 455 metres from its junction with the Carrigahorig-Ballinderry road.

17. The following road in and adjacent to the Urban District of Thurles:—

The Templemore Road (National Road N62) for a distance of 660 metres from the point where the boundary of the urban district of Thurles intersects the eastern side of the road.

18. The following roads at Two-Mile-Borris:—

( a ) The Thurles-Turnpike road (National Road N75) between a point 183 metres east of its junction with the Moyne Road and a point 410 metres west of the said junction.

( b ) The Moyne Road for a distance of 137 metres from its junction with the Thurles-Turnpike road.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Tipperary) (North Riding) Regulations, 1981 ( S.I. No. 176 of 1981 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit of 30 mph prescribed by section 45 of the Road Traffic Act, 1961 thus enabling a special speed limit of 40 mph to be applied to some of these roads.

The Regulations declare that the roads mentioned in the Second Schedule, which would otherwise be outside the scope of the built-up area speed limit of 30 mph, shall be subject to that limit.

The Regulations prescribe a speed limit of 40 mph in respect of the public roads mentioned in the Third Schedule. Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
