TELEX (AMENDMENT) SCHEME 1986.

BORD TELECOM ÉIREANN, in exercise of the powers conferred on it by Section 90 of the postal and Telecommunications Services Act, 1983 (No. 24 of 1983), hereby makes the following Scheme:

1. (1) This Scheme may be cited as the Telex (Amendment) Scheme, 1986.

(2) The Telex Schemes, 1980 to 1985, and this Scheme may be cited together as the Telex Schemes 1980 to 1986.

2. This Scheme shall come into operation on the 1st day of April 1986. However, without prejudice to any other right in that behalf, Bord Telecom Éireann may, for operational reasons, postpone in whole or in part the implementation of this Scheme in respect of such groups of subscribers or areas of the State as it shall determine provided that such postponement shall not exceed two months.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.

4. The Minister for Communications, pursuant to Section 90 (2) of the Postal and Telecommunications Services Act, 1983 , has concurred in the increase of charges effected by this Scheme.

5. The Telex Regulations, 1980 ( S.I. No. 197 of 1980 ), are hereby amended by:

( a ) the substitution of the following paragraph for paragraph (5) (inserted by paragraph 6 (c) of the Telex (Amendment) (No. 2) Scheme, 1985 ( S.I. No. 188 of 1985 ) of Regulation 9:

"The subscriber shall pay on demand to Bord Telecom Éireann for the use of a Telex line provided by Bord Telecom Éireann and for the use of subscribers's terminal equipment supplied by Bord Telecom Éireann otherwise than by sale the subscriptions specified by Part V of the Schedule to these Regulations as appropriate to the line or the type of equipment."

( b ) the substitution of the following Schedule for the Schedule thereto (inserted as to Parts I to IV by paragraph 5(c) of the Telex (Amendment) Scheme, 1985 ( S.I. No. 80 of 1985 ) and as to Part V by paragraph 12 of the Telex (Amendment) (No. 2) Scheme, 1985 ( S.I. No. 188 of 1985 )):

The charge for a subscriber keyed call shall be the sum of 22.2p in respect of each period or part of a period of time specified in the Table to this Part of the Schedule which is appropriate to the call and during which the call continues, except in the case of 7. below where subscriber keyed calls are charged for on a per minute basis.
