WIRELESS TELEGRAPHY (BUSINESS RADIO LICENCE) (AMENDMENT) REGULATIONS, 1986.

I, JIM MITCHELL, Minister for Communications, in exercise of the powers conferred on me by section 6 (1) of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), and section 3 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and with the consent of the Minister for Finance, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Wireless Telegraphy (Business Radio Licence) (Amendment) Regulations, 1986.

(2) The Wireless Telegraphy (Business Radio Licence) Regulations, 1949 to 1985, and these Regulations may be cited together as the Wireless Telegraphy (Business Radio Licence) Regulations, 1949 to 1986.

(3) The Regulations shall come into operation on the 1st day of April, 1986.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

"the Regulations of 1949" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1949 ( S.I. No. 320 of 1949 );

"the Regulations of 1956" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1956 ( S.I. No. 2 of 1956 );

"the Regulations of 1957" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1957 ( S.I. No. 181 of 1957 );

"the Regulations of 1985" means the Wireless Telegraphy (Business Radio Licence) (Amendment) Regulations, 1985 ( S.I. No. 84 of 1985 ).

4. Regulation 9 (1) of the Regulations of 1949 (inserted by Regulation 4 of the Regulations of 1956 and amended by Regulation 4 of the Regulations of 1985) is hereby amended by—

(a) the substitution in subparagraph (a) of "fourteen pounds and fifty new pence" for "thirteen pounds and fifty new pence" in both places where the words occur;

(b) the substitution in subparagraph (b) of "fourteen pounds and fifty new pence", "fourteen pounds and fifty new pence", and "forty-eight pounds and fifty new pence" for "thirteen pounds and fifty new pence," "thirteen pounds and fifty new pence" and "forty-six pounds", respectively;

(c) the substitution in subparagraph (c) of "sixty-five pounds and fifty new pence" and "fourteen pounds and fifty new pence" for "sixty-two pounds" and "thirteen pounds and fifty new pence", respectively;

(d) the substitution in subparagraph (d) of "sixty-five pounds and fifty new pence", "fourteen pounds and fifty new pence" and "forty-eight pounds and fifty new pence" for "sixty-two pounds", "thirteen pounds and fifty new pence" and "forty-six pounds", respectively;

and the said paragraph (1), as so amended, is set out in the Table to this Regulation.

TABLE

(1) A fee shall be payable on the issue and on each renewal of a business radio licence and such fee shall be calculated on the following basis:

(a) system comprising base and mobile stations only or system comprising mobile stations only: a fixed sum of fourteen pounds and fifty new pence plus fourteen pounds and fifty new pence for each station,

(b) system comprising base, repeater and mobile stations or mobile and repeater stations: a fixed sum of fourteen pounds and fifty new pence plus fourteen pounds and fifty new pence for each base station and each mobile station plus forty-eight pounds and fifty new pence in respect of each repeater station,

(c) system comprising two fixed stations only, that is to say, a fixed point to point system: a fixed sum of sixty-five pounds and fifty new pence plus fourteen pounds and fifty new pence for each station,

(d) system comprising two fixed stations with repeater stations, that is to say, a fixed point-to-point system with repeater stations: a fixed sum of sixty-five pounds and fifty new pence plus fourteen pounds and fifty new pence for each fixed station plus forty-eight pounds and fifty new pence in respect of each repeater station.

5. Regulation 7 of the Regulations of 1957 (as amended by Regulation 5 of the Regulations of 1985) is hereby amended by—

(a) the substitution in paragraph (a) of "eight pounds and fifty new pence" for "eight pounds" in both places where the words occur;

(b) the substitution in paragraph (b) of "eight pounds and fifty new pence" for "eight pounds" in both places where it occurs and of "thirty-two pounds and fifty new pence" for "thirty-one pounds";

(c) the substitution in paragraph (c) of "forty-one pounds" and "eight pounds and fifty new pence" for "thirty-nine pounds" and "eight pounds", respectively; and

(d) the substitution in paragraph (d) of "forty-one pounds", "eight pounds and fifty new pence" and ` `thirty-two pounds and fifty new pence" for "thirty-nine pounds", "eight pounds" and "thirty-one pounds", respectively;

and the said Regulation 7, as so amended, is set out in the Table to this Regulation.

(d) system comprising two fixed stations with repeater stations, that is to say, a fixed point-to-point system with repeater stations: a fixed sum of forty-one pounds plus eight pounds and fifty new pence for each fixed station plus thirty-two pounds and fifty new pence in respect of each repeater station.
