INSURANCE (No. 2) ACT, 1983 (SECTION 3) (ACCOUNTING PERIOD) ORDER, 1986.

I, JOHN BRUTON, Minister for Industry, Trade, Commerce and Tourism, in exercise of the powers conferred on me by section 3 (6) of the Insurance (No. 2) Act, 1983 (No. 29 of 1983), and considering it appropriate to do so to facilitate the performance of the functions of the administrator appointed on the 15th day of March, 1985, under that Act, hereby order as follows:

1. This Order may be cited as the Insurance (No. 2) Act, 1983 (Section 3) (Accounting Period) Order, 1986.

2. This Order shall be deemed to have come into operation on the 1st day of January, 1986.

3. The Companies Act, 1963 (No. 33 of 1963), is hereby modified in its application under and for the purposes of the Insurance (No. 2) Act, 1983 (No. 29 of 1983), as follows, that is to say—

(a) the obligation imposed on the administrator appointed on the 15th day of March, 1985, by sections 148, 150 and 158 of the said Companies Act, 1963 , as modified by the said Insurance (No. 2) Act, 1983 , and by the Insurance (No. 2) Act, 1983 , (Section 3) Order, 1985 (S.I. No. 226 of 1985) (as amended by the Insurance (No. 2) Act, 1983 (Section 3) (Amendment) Order, 1985 ( S.I. No. 330 of 1985 )) to deliver specified documents to the registrar of companies—

(i) where such documents relate to the year 1984, not later than twelve months after the end of that year, and

(ii) where such documents relate to any other year, not later than six months after the end of such other year, shall, as respects such documents relating to the period consisting of the years 1984 and 1985, be construed as an obligation imposed on the administrator to deliver the documents for those years combined to the registrar of companies not later than six months after the end of that period, and

(b) the obligation imposed on the auditors of a company by section 163 of the said Companies Act, 1963 , as modified as aforesaid, to deliver a report on the matters specified in the said section 163 to the registrar of companies—

(i) where the report relates to the year 1984, not later than twelve months after the end of that year, and

(ii) where the report relates to any other year, not later than six months after the end of such other year, shall as respects of the reports relating to the period consisting of the years 1984 and 1985, be construed as an obligation imposed on the auditors to deliver a report for those years combined to the registrar of companies not later than six months after the end of that period.

EXPLANATORY NOTE.

This Order permits the report and accounts in respect of the year ended 31 December, 1984 of an insurance company under administration since 15 March, 1985 to be combined with those for the year ended 31 December, 1985 for the purposes of submission to the Registrar of Companies.
