LOCAL GOVERNMENT REORGANISATION (SUPPLEMENTARY PROVISIONS) (CORK) ORDER, 1985.

The Minister for the Environment, in exercise of the powers conferred on him by section 28 (3) of the Local Government (Reorganisation) Act, 1985 (No. 7 of 1985), hereby orders as follows:—

1. This Order may be cited as the Local Government Reorganisation (Supplementary Provisions) (Cork) Order, 1985.

2. In this Order—

"the Act of 1985" means the Local Government (Reorganisation) Act, 1985 ;

"the added area" means the land referred to in section 28 (1) (a) of the Act of 1985;

"the County Council" means the council of the county of Cork;

"the County" means the administrative county of Cork;

"the Minister" means the Minister for the Environment.

3. (1) As soon as may be after the commencement of section 28 of the Act of 1985, the Commissioner of Valuation shall prepare in triplicate a map drawn to such convenient scale and in such convenient number of separate sheets as he shall think fit showing the added area and when such maps have been prepared he shall seal each such map and shall, as soon as may be thereafter, deposit them as follows, namely, one of them in the principal office of the said Commissioner, another in the offices of the County Council and another in the offices of the Minister.

(2) Every map deposited pursuant to paragraph (1) of this article in the principal office of the Commissioner of Valuation or in the offices of the County Council shall be retained in the office or offices in which it is so deposited and each such map, or true copies thereof, shall be open for inspection free of charge at the office or offices in which it is so deposited by any person at any time at which such office or offices is or are open for the transaction of public business, and it shall be lawful for the said Commissioner or the County Council to prepare and supply to any person requesting the same a true copy of the map so deposited with him or them or any particular part thereof and to charge for such copy such sum as he, with the consent of the Minister for Finance, or they, may fix.

(3) It shall be the duty of the Commissioner of Valuation and the County Council, respectively, whenever required so to do by any Court of Justice, to prepare and produce to such Court a true copy of the map deposited with him or them under this article or any specified part thereof and to verify such copy to such Court by the oath of one of his or their officers, and, upon any such copy being so produced and verified to such Court, such Court shall receive such copy in evidence and thereupon such copy shall, unless the contrary is shown, be sufficient evidence of the added area (in so far as the same are shown on such copy), notwithstanding any discrepancy between such copy and the description of the added area contained in section 28 (1) (a) of the Act of 1985 or any ambiguity or uncertainty in such description or in the application thereof.

4. On the commencement of section 28 of the Act of 1985—

( a ) the part of the added area situated within a line drawn as follows shall be added to the district electoral division of Kilcaskan:—

commencing at Muccurragh Point, thence initially in a north-easterly direction along the southern boundary of the district electoral division of Kilcaskan to its junction with the western boundary of the townland of Dromgarriff, thence in a south-westerly direction along the last-mentioned boundary to its westernmost point, thence in a southerly direction along an imaginary straight line drawn from the last-mentioned point to Gun Point, thence in a south-easterly direction along an imaginary straight line drawn from Gun Point to the westernmost point of Carrigskye Island, thence in a south-westerly direction along an imaginary straight line drawn from the last-mentioned point to the starting point;

( b ) the parts of the added area situated within lines drawn as follows shall be added to the district electoral division of Glengarriff:—

(i) commencing at the westernmost point of the townland of Dromgarriff, thence in a southerly direction along an imaginary straight line drawn from the said point to Gun Point, thence initially in a north-easterly direction along the western boundary of the townlands of Iskanafeelna and Dromgarriff to the starting point, and

(ii) commencing at Gun Point, thence in a south-easterly direction along an imaginary straight line drawn from Gun Point to the westernmost point of Carrigskye Island, thence in a south-easterly direction along an imaginary straight line drawn from the last-mentioned point to Whiddy Point East, thence in an easterly direction along an imaginary straight line drawn from Whiddy Point East to Reenydonagan Point, thence initially in a north-easterly direction along the western boundaries of the townlands of Reenydonagan, Laharan West and Ballylickey to the junction of the western boundary of the townland of Ballylickey with the southern boundary of the district electoral division of Glengarriff, thence initially in a south-westerly direction along the said boundary to the starting point.

( c ) the part of the added area situated within a line drawn as follows shall be added to the district electoral division of Whiddy:—

commencing at Muccurragh Point, thence in a north-easterly direction along an imaginary straight line drawn from Muccurragh Point to the westernmost point of Carrigskye Island, thence in a south-easterly direction along an imaginary straight line drawn from the last-mentioned point to Whiddy Point East, thence in an easterly direction along an imaginary straight line drawn from Whiddy Point East to Rennydonagan Point, thence initially in a south-easterly direction along the boundaries of the district electoral divisions of Bantry Rural, Bantry Urban and Bantry Rural, thence commencing in a westerly direction and proceeding along the northern boundary of the district electoral division of Durrus West to its junctions with an imaginary straight line drawn from League Point to Muccuragh Point, thence in a northerly direction along the said imaginary straight line to the starting point.

5. On the commencement of section 28 of the Act of 1985 the added area shall form part of the West Cork county health district.

EXPLANATORY NOTE.

This Order contains supplementary provisions arising from the commencement of section 28 of the Local Government (Reorganisation) Act, 1985 which operates, inter alia, to extend the maritime boundary of County Cork to include part of Bantry Bay.
