ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF CAVAN) REGULATIONS, 1985.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Cavan) Regulations, 1985.

2 Commencement.

2. These Regulations shall come into operation on the 18th day of March, 1985.

3 Interpretation.

3. In these Regulations save where the context otherwise requires—

"the Act" means the Road Traffic Act, 1961 ;

"national road" means a road declared to be a national road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such roads shall be a reference to the number of such road as shown in column 1 of the First and Second Schedules to the aforementioned Order;

"distance" means distance as measured along the centre line of a road;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a town;

"special speed limit" and "built-up area speed limit" have the meaning respectively assigned to them in Part IV of the Act.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Síochána, in the performance of their duties as such members.

7 Revocations.

7. The Road Traffic (Speed Limits) (County of Cavan) Regulations, 1979 ( S.I. No. 283 of 1979 ) and the Road Traffic (Speed Limits) (County of Cavan) (Amendment) Regulations, 1980 ( S.I. No. 279 of 1980 ) are hereby revoked.

FIRST SCHEDULE.

Roads in the County of Cavan declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Belturbet:

(a) The Rosskeeragh Road, The Aghalane Road, The Grilly Road, The Creeny Road, Noghan Lane.

(b) The Cavan Road (National Road N3) between the town boundary and a point 18 metres north-west of the westernmost entrance to Marian Park.

(c) The Straheglin Road between the town boundary and a point 14 metres south of Mill Hill.

(d) The Kilconny Road between its junction with the Aghalane Road and a point 297 metres west of its eastern junction with the Ballyconnell Road.

(e) The Ballyconnell Road (National Road N3) for a distance of 575 metres from the town boundary at the junction of the said road with the Aghalane Road.

(f) The road connecting the Kilconny Road with Buttermilk Bridge.

(g) The Noghan Road between the town boundary and a point 92 metres north-east of its junction with the Kilconny Road.

(h) The Clones Road between the point where the town boundary intersects the southern side of the road and the centre line of Creeny Bridge.

2. The following roads in the Urban District of Cavan:—

(a) Keadew Lane between the urban district boundary and a point 28 metres from its junction with the Belturbet Road.

(b) The Belturbet Road (National Road N3) between the urban district boundary and a point 92 metres north of its junction with the Cootehill Road.

(c) The Cootehill Road for a distance of 180 metres from the urban district boundary.

(d) The Cock Hill Road for a distance of 292 metres from the urban district boundary.

(e) The Old Dublin Road between the urban district boundary and a point 46 metres north-east of its junction with the Dublin Road (National Road N3).

(f) The road leading north-westwards from the Old Dublin Road towards Gallows Hill between its junction with the Old Dublin Road and a point 120 metres south-east of the Fair Green.

(g) The Swellan Road between the urban district boundary and a point 28 metres south of its junction with the road leading north-eastwards towards Station Road.

3. The following roads in the town of Cootehill:

(a) The Lisnasaran Road, The Redhills Road, The Pound Road.

(b) The Monaghan Road between the town boundary and a point 137 metres south-east of its junction with the Redhills Road.

(c) The Shercock Road between the town boundary and a point 69 metres south-east of its junction with the New Line.

(d) The Mountain Lodge Road between the town boundary and a point 28 metres north of its junction with the Pound Road.

SECOND SCHEDULE.

Roads in the County of Cavan declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Arvagh:

(a) Broad Road, Longford Street, Pound Street, Porter's Row.

(b) The Cavan-Carrigallen road between a point 20 metres north-west of its junction with the Gowna Road and a point 275 metres north-west of its junction with Pound Street.

(c) The Drumlish Road for a distance of 183 metres from its junction with Pound Street.

(d) The Ballinalee Road for a distance of 115 metres from its junction with Broad Road.

2. The following roads at Bailieborough:—

(a) Church Street, Henry Street, Main Street, Market Square, New Road, William Street.

(b) The Shercock Road for a distance of 343 metres from its junction with Main Street.

(c) The Cavan Road for a distance of 366 metres from its junction with Church Street.

(d) The Galbolie Road for a distance of 255 metres from its junction with Henry Street.

(e) Barrack Street and its continuation as the Virginia Road between its junction with Main Street and a point 338 metres south-west of its junction with the Ceanannus Mor Road.

(f) The Ceanannus Mor Road for a distance of 92 metres from its junction with the Virginia Road.

(g) The Institute Road for a distance of 101 metres from its junction with Market Square.

(h) Church Lane for a distance of 666 metres from its junction with Church Street.

(i) The Kingscourt Road for a distance of 183 metres from the junction of Thomas Street with Main Street.

3. The following roads at Ballyconnell:

(a) The Old Road, Doon or Mucklagh Lane, Doon Cottages Road, Mount Pleasant Road.

(b) The Belturbet-Swanlinbar road between a point 362 metres north-west of its junction with the Aghalane Road and a point 403 metres north-west of its junction with Main Street.

(c) The Killeshandra Road for a distance of 576 metres from its junction with the Belturbet-Swanlinbar road.

(d) The Ballinamore Road for a distance of 138 metres from its junction with the Belturbet-Swanlinbar road.

(e) Main Street and its continuation as the Derrylin Road for a distance of 640 metres from the junction of Main Street with the Belturbet-Swanlinbar road.

4. The following roads at Ballyhaise:

(a) The Square.

(b) The Cavan-Clones road between a point 604 metres south-west of its junction with the Bog Road and a point 366 metres north-east of the said junction.

(c) The Bog Road for a distance of 120 metres from its junction with The Square.

5. The following roads at Ballyjamesduff:

(a) Brewery Lane, Market Street, Percy French Park, Percy French Place, Water Lane, Anne Street.

(b) Dublin Street and its continuation to the Cavan Road.

(c) The Virginia Road for a distance of 789 metres from its junction with Dublin Street.

(d) Chapel Street and its continuation as the Oldcastle Road for a distance of 412 metres from the junction of Chapel Street with Granard Street.

(e) Granard Street and its continuation as the Granard Road for a distance of 293 metres from the junction of Granard Street with Chapel Street.

(f) The Ramonan Road for a distance of 46 metres from its junction with the Granard Road.

(g) The Rassan Road for a distance of 156 metres from its junction with the Cavan Road.

(h) The Cavan Road between the northern end of Market Street and a point 485 metres north-west of its junction with the Lishenry Road.

(i) The Lishenry Road for a distance of 210 metres from its junction with the Cavan Road.

(j) Stradone Street and its continuation as the New Inns Road for a distance of 275 metres from the junction of Stradone Street with Dublin Street.

6. The following roads at Bellannagh:

(a) The Cavan-Athlone road (National Road N55) between a point 70 metres north-east of its junction with the Garrymore Road and a point 230 metres north-east of its junction with the Crossdoney Road.

(b) The Dublin Road for a distance of 211 metres from its junction with the Cavan-Athlone road (National Road N55).

(c) The Crossdoney Road for a distance of 320 metres from its junction with the Cavan-Athlone road (National Road N55).

7. The following roads at Blacklion:—

(a) The Florencecourt or Belturbet Road for a distance of 183 metres from its junction with the Enniskillen Road (National Road N16).

(b) The Enniskillen Road (National Road N16) between its junction with the Manorhamilton Road (National Road N16) and the boundary between the counties of Cavan and Fermanagh at Belcoo Bridge.

(c) The Manorhamilton Road (National Road N16) for a distance of 297 metres from its junction with the Enniskillen Road (National Road N16).

8. The following roads at Butlers Bridge:

(a) The Cavan-Belturbet road (National Road N3) between a point 323 metres south-east of its junction with the Clones Road (National Road N54) and a point 74 metres north-west of the said junction.

(b) The Clones Road (National Road N54) for a distance of 274 metres from its junction with the Cavan-Belturbet road (National Road N3).

9. The following roads adjacent to the Urban District of Cavan:

(a) The Drumavanagh housing estate Road.

(b) The Dublin Road (National Road N3) between the boundary of the urban district of Cavan and a point 183 metres east of its junction with the Mullingar Road (National Road N55).

(c) The Athlone Road (National Road N55) between the boundary of the urban district of Cavan and a point 273 metres south-east of the said boundary.

(d) The Killeshandra Road between the boundary of the urban district of Cavan and a point 23 metres north-west of its junction with the Drumavanagh housing estate Road.

(e) The Billis Road for a distance of 400 metres from its junction with the Cootehill Road.

10. The following roads adjacent to the town of Cootehill:—

(a) The Old Cavan Road.

(b) The Cavan Road where the said road is a perimeter road.

11. The following roads at Dowra:

(a) The Drumkeeran-Ballyconnell road between a point 165 metres south-west of its junction with the Blacklion Road and the boundary between the counties of Cavan and Leitrim at the Shannon Bridge.

(b) Main Street and its continuation as the Blacklion Road for a distance of 200 metres from the junction of Main Street with the Drumkeeran-Ballyconnell road.

12. The following roads at Killeshandra:

(a) The Station Road.

(b) The Cavan-Ballyconnell road between a point 320 metres south-east of its junction with the Arvagh Road and a point 586 metres north-west of its junction with the Belturbet Road.

(c) The Arvagh Road for a distance of 200 metres from its junction with the Cavan-Ballyconnell road.

(d) The Carrigallen Road for a distance of 302 metres from its junction with the Cavan-Ballyconnell road.

(e) The Belturbet Road for a distance of 256 metres from its junction with the Cavan-Ballyconnell road.

13. The following roads at Kilnaleck:

(a) The road to the County Council dump.

(b) The Cavan-Oldcastle road between a point 274 metres north-west of its junction with the Crosskeys Road and a point 611 metres south-east of the said junction.

(c) The road leading westward from the Cavan-Oldcastle road at a point approximately 83 metres south-east of the junction of the latter road with the Crosskeys Road.

(d) The Fair Green Road for a distance of 110 metres from its junction with the Cavan-Oldcastle road.

(e) The Crosskeys Road for a distance of 485 metres from its junction with the Cavan-Oldcastle road.

(f) The Old Road for a distance of 92 metres from its northernmost junction with the Cavan-Oldcastle road.

14. The following roads at Kingscourt:

(a) Main Street, Market Square, Mount Saint Joseph's Cottages Road.

(b) The Shercock Road for a distance of 448 metres from its junction with the Bailieborough Road.

(c) The Carrickmacross Road for a distance of 458 metres from its junction with Main Street.

(d) The Enniskeen Road for a distance of 101 metres from its junction with Main Street.

(e) The Nobber Road for a distance of 777 metres from its junction with the Enniskeen Road.

(f) Hall Street and its continuation as Moynalty Road for a distance of 471 metres from the junction of Hall Street with Main Street.

(g) The parts of St. Mary's Road between Hall Street and the Rocks Road and between the Rocks Road and the Bailieborough Road.

(h) The Rocks Road for a distance of 375 metres from its junction with Market Square.ivc

(i) The Bailieborough Road between its junction with Main Street and a point 283 metres north-west of its junction with Cornakill Lane.y

(j) Cornakill Lane for a distance of 46 metres from its junction with the Bailieborough Road.

15. The following roads at Milltown:—

(a) The Belturbet-Killeshandra road between a point 271 metres north of its junction with the Baker's Bridge Road and a point 91 metres south-west of the said junction.

(b) The Ardonan Road for a distance of 190 metres from its junction with the Killeshandra-Belturbet road.

(c) The road to Drumlane Abbey for a distance of 30 metres from its junction with the Ardonan Road.

(d) The Drumgesh Road for a distance of 95 metres from its junction with the Killeshandra-Belturbet road.

(e) The Baker's Bridge Road for a distance of 95 metres from its junction with the Killeshandra-Belturbet road.

16. The following roads at Mullagh:—

(a) The Virginia-Moynalty road between a point 562 metres south-west of its junction with the Bailieborough-Whitegate road and a point 138 metres south-east of its junction with the Rosehill Road.

(b) The Bailieborough Road for a distance of 229 metres from its junction with the Virginia-Moynalty road.

(c) The Whitegate Road for a distance of 92 metres from its junction with the Virginia-Moynalty road.

(d) The Newcastle Road for a distance of 110 metres from its junction with the Virginia-Moynalty road.

(e) The Rosehill Road for a distance of 23 metres from its junction with the Virginia-Moynalty road.

17. The following roads at Redhills:—

(a) The Belturbet-Cootehill road between a point 402 metres south-east of its junction with the Scotshouse Road and a point 335 metres north-west of the said junction.

(b) The Scotshouse Road for a distance of 195 metres from its junction with the Belturbet-Cootehill road.

18. The following roads at Shercock:—

(a) Main Street.

(b) The Bailieborough Road for a distance of 384 metres from its junction with Main Street.

(c) The Cavan Road for a distance of 231 metres from its junction with the Cootehill Road.

(d) The Cootehill Road for a distance of 128 metres from its junction with Main Street.

(e) The Bleech Cross Road for a distance of 69 metres from its junction with Main Street.

(f) The Carrickmacross Road for a distance of 92 metres from its junction with Main Street.

(g) The Kingscourt Road for a distance of 544 metres from its junction with the Carrickmacross Road.

19. The following roads at Swanlinbar:

(a) The Cavan-Enniskillen road between a point 183 metres south of its junction with the Derrylin Road and a point 261 metres north-east of its junction with the Glangevlin Road.

(b) The Derrylin Road for a distance of 334 metres from its junction with the Cavan-Enniskillen road.

(c) The Drumcask Road for a distance of 69 metres from its junction with the Cavan-Enniskillen road.

(d) The Glangevlin Road for a distance of 247 metres from its junction with the Cavan-Enniskillen road.

20. The following roads at Virginia:

(a) Rahardrum Cottages Lanes, New Street.

(b) The Cavan-Ceanannus Mor road (National Road N3) between a point 420 metres north-west of its junction with the Ballyjamesduff Road and a point 398 metres south-east of its junction with the Bailieborough Road.

(c) The Bailieborough Road for a distance of 464 metres from its junction with the Cavan-Ceannannus Mor road (National Road N3).

(d) The Ballyjamesduff Road for a distance of 395 metres from its junction with the Cavan-Ceanannus Mor road (National Road N3).

THIRD SCHEDULE.

Roads in the County of Cavan in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads at Bailieborough:

(a) The roads serving the Drumbannon Cottages.

(b) The Cavan Road between a point 366 metres from its junction with Church Street and a point 727 metres from the said junction.

2. The following road at Ballyjamesduff::—

The Oldcastle Road between a point 412 metres from the junction of Chapel Street with Granard Street and a point 934 metres from the said junction.

3. The following roads at Bawnboy:

(a) The Ballyconnell-Swanlinbar road between a point 96 metres south-east of its junction with the Ballinamore Road and a point 366 metres north-west of the said junction.

(b) The Ballinamore Road for a distance of 385 metres from its junction with the Ballyconnell-Swanlinbar road.

4. The following roads in the town of Belturbet:

(a) Marian Park.

(b) The Cavan Road between a point 23 metres west of its junction with the Golf Links Road and a point 18 metres north-west of its westernmost junction with Marian Park.

5. The following road at Bellananagh:

The Cavan Road (National Road N55) between a point 230 metres north-east of its junction with the Crossdoney Road and a point 530 metres north-east of the said junction.

6. The following roads in and adjacent to the Urban District of Cavan::—

(a) The Belturbet Road between a point 92 metres north of its junction with the Cootehill Road and a point 521 metres north of the said junction.

(b) The Cootehill Road between a point 800 metres north-east of the boundary of the urban district of Cavan and a point 180 metres south-west of the said boundary.

(c) The Killeshandra Road between a point 23 metres north-west of its junction with the Drumavanagh housing estate Road and a point 425 metres north-west of the said junction.

(d) The former Golf Links Road for a distance of 381 metres from its junction with the Killeshandra Road.

(e) The Athlone Road (National Road N55) between a point 273 metres south-east of the boundary of the urban district of Cavan and a point 500 metres south-east of the said boundary.

7. The following roads in the town of Cootehill::—

(a) The Shercock Road between a point 69 metres south-east of its junction with the New Line and a point 92 metres north-west of its junction with the Lisnasaran Road.

(b) The Redhills Road for a distance of 900 metres from its junction with the Monaghan Road.

(c) The Monaghan Road between a point 137 metres south-east of its junction with the Redhills Road and a point 50 metres north of the said junction.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Cavan) Regulations, 1979 ( S.I. No. 283 of 1979 ) and the Road Traffic (Speed Limits) (County of Cavan) (Amendment) Regulations, 1980 ( S.I. No. 279 of 1980 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 milesper hour in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and vehicles used by the Garda Siochána in the course of duty are exempted from all speed limits by the Regulations.
