POISONS (AMENDMENT) REGULATIONS, 1984.

The Minister for Health, in exercise of the powers conferred on him by section 14 of the Poisons Act, 1961 (No. 12 of 1961) as amended by section 33 of the Misuse of Drugs Act, 1977 (No. 12 of 1977) after consultation with Comhairle na Nimheanna, hereby makes the following Regulations:

1. (1) These Regulations may be cited as the Poisons (Amendment) Regulations, 1984.

(2) These Regulations shall be construed as one with the Poisons Regulations, 1982 and 1983 and may be cited together with those Regulations as the Poisons Regulations, 1982 to 1984.

2. In these Regulations "the Principal Regulations" means the Poisons Regulations, 1982 ( S.I. No. 188 of 1982 ).

3. The Principal Regulations are hereby amended:—

(1) by the deletion of the words "or (b)" in article 7(4) (c).

(2) by the insertion of the following sub-article in article 8—

"(9) The provisions of this article set out in sub-article (2) (b) shall not apply in respect of compounds of Fentin."

(3) by the substitution of the words "1.14 litres" for the words "one litre" in article 11(2).

(4) by the substitution of the following sub-article for sub-article 11(3)—

"(3) Sub-article (2) shall not apply as respects the sale or supply of—

(i) a poison to a person or institution concerned with scientific education, research or chemical analysis for the purposes of such education, research or analysis;

(ii) a poison intended for the internal treatment of human ailments, or when presented in plastic containers as ear drops and sterile eye drops;

(iii) salts of paraquat in liquid form for use as a pesticide in a closed bottle of a capacity not exceeding 700 millilitres which has been approved by the Minister and which has been closed by the manufacturer."

(5) by the substitution of the following paragraph for paragraph (a) of sub-article 19(4)—

"(a) it is a substance to which the European Communities (Dangerous Substances) (Classification, Packaging and Labelling) Regulations, 1979 to 1983 and the European Communities (Dangerous Substances) (Classification, Packaging, Labelling and Notification) Regulations, 1982 ( S.I. No. 258 of 1982 ) apply, and".

(6) by the addition of the words "Zeranol; its esters" after "Xylazine; its salts" in Part I of the First Schedule.

(7) by the addition of the words "Corticosteroid substances, the following; their esters:— Alclometasone, Aldosterone, Beclomethasone, Betamethasone, Clobetasol, Clobetasone, Cortisone, Cortivazol, Deoxycorticosterone, Desonide, Desoxymethasone, Dexamethasone, Diflucortolone, Fluclorolone acetonide, Fludrocortisone, Flumethasone, Flunisolide, Fluocinolone acetonide, Fluocinonide, Fluocortolone, Fluorometholone, Fluperolone, Fluprednidene, Fluprednisolone, Flurandrenolone, Formocortal, Halcinonide, Medrysone, Meprednisone, Methylprednisolone, Paramethasone, Prednisolamate, Prednisone, Prednylidene, Triamcinolone, Triamcinolone acetonide, Triamcinolone hexacetonide" after the word "Colaspase" in Part I of the First Schedule.

(8) by the addition of the words "Corticosteroid substances, the following; their esters:— Hydrocortisone, Prednisolone" after the word "Carbofuran" in Part II of the First Schedule.

(9) by the addition to Part III of the Fourth Schedule of the words "Corticosteroid substances, the following; their esters:— Hydrocortisone, Prednisolone".

4. The Poisons (Amendment) Regulations, 1983 are hereby amended by the substitution of "1st day of November, 1986" for "1st day of January, 1985" in article 3(1).

5. The provisions of these Regulations other than article 4 shall come into operation on the 1st day of June, 1985.

6. Article 4 of these Regulations shall come into force on the 1st day of January, 1985.

EXPLANATORY NOTE.

The Regulations amend the Poisons Regulations, 1982 and 1983. They have the effect of deferring the labelling, packaging and colouring requirements of the Poisons Regulations, 1982 in respect of certain pesticides. They also impose requirements and restrictions on the sale of corticosteroids and Zeranol. In addition the labelling requirements for animal remedies, the record-keeping requirements for Fentin compounds and the container requirements for certain Second Schedule poisons are being modified.
