ROAD TRAFFIC (LICENSING OF DRIVERS) (AMENDMENT) (No. 2) REGULATIONS, 1984.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 33 and 42 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:

1. These Regulations may be cited as the Road Traffic (Licensing of Drivers) (Amendment) (No. 2) Regulations, 1984.

2. These Regulations and the Road Traffic (Licensing of Drivers) Regulations, 1964 to 1984 shall be construed as one and the expression the Road Traffic (Licensing of Drivers) Regulations, 1964 to 1984 shall include these Regulations.

3. These Regulations shall come into operation on the 1st day of October, 1984.

4. In these Regulations—

"national driving licence" means a licence to drive a vehicle (not being a licence issued to a person to enable him to learn to drive) issued by the competent authority of a Member State, other than Ireland, of the European Economic Communities.

5. Article 29 of the Road Traffic (Licensing of Drivers) Regulations, 1964 ( S.I. No. 29 of 1964 ) as substituted by article 9 of the Road Traffic (Licensing of Drivers) (Amendment) Regulations, 1981 ( S.I. No. 198 of 1981 ) is hereby amended by the substitution for sub-paragraph (i) of paragraph (a) of sub-article (1) of the following sub-paragraph—

"(i) the application

(A) is made by a person who holds a valid national driving licence and who surrenders such licence to the licensing authority with the application,

(B) is made within one year of that person taking up normal residence in the State,

(C) relates to a class or classes without limitation, or to a specified type of vehicle belonging to a class, in respect of which the applicant holds such licence,

(D) is accompanied by a statement by the applicant that such licence is valid at the date of application,

or".

EXPLANATORY NOTE.

These Regulations give effect to Article 8 of Council Directive 80/1263/EEC (Driver Licensing) to the extent that they provide that a person who holds a valid national driving licence issued by a Member State of the European Communities (other than Ireland) may, within 12 months of taking up normal residence in the State, apply for and be granted an equivalent Irish licence on surrender of his national licence.
