DISTRICT COURT AREAS (VARIATION OF DAYS, HOURS, AREAS AND DISTRICTS) ORDER, 1984.

I, MICHAEL NOONAN, Minister for Justice, in exercise of the powers conferred on me by section 26 of the Courts of Justice Act, 1953 (No. 32 of 1953), and after consultation with the President of the District Court, hereby order as follows:

1. (1) This Order may be cited as the District Court Areas (Variation of Days, Hours, Areas and Districts) Order, 1984.

(2) This Order shall come into operation on the 1st day of October 1984.

2. In this Order "the Principal Order" means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ).

3. The First Schedule to the Principal Order is hereby amended by—

(a) the deletion in columns (3) and (4) at reference number 205 of "Cloghan" (inserted by the District Court Districts and Areas (Amendment) Order, 1979 ( S.I. No. 20 of 1979 )),

(b) the substitution in column (4) at reference number 206 of "Third Friday in each month at 11 a.m." for "Fourth Thursday in January, March, May, July, September and November at 11 a.m.", and

(c) the insertion in column (5) at reference number 206 after "Kilcormac", of "Cloghan, Clonmacnoise, Doon, Ferbane, Gallen, Hinds, Huntston, Lea, Lumcloom, Moyclare, Shannon Bridge, Srah,".

4. The Second Schedule to the Principal Order is hereby amended by—

(a) the deletion in columns (3) and (4) at reference number 175 of "Cloghan" (inserted by the District Court Districts and Areas (Amendment) Order, 1979 ( S.I. No. 20 of 1979 )),

(b) the substitution in column (4) at reference number 176 of "Third Friday in each month at 11 a.m." for "Fourth Thursday in January, March, May, July, September and November at 11 a.m.", and

(c) the substitution in column (5) at reference number 176 of "Kilcormac, Cloghan, Clonmacnoise, Doon, Ferbane, Gallen, Hinds, Huntston, Lea, Lumcloom, Moyclare, Shannon Bridge, Srah" for "Frankford".

5. The District Court (Districts) Order, 1961 ( S.I. No. 6 of 1961 ), is hereby amended by the deletion in column (3) of the First and Second Schedules thereto at reference number 8 of "Cloghan" (inserted by the District Court Districts and Areas (Amendment) Order, 1979 ( S.I. No. 20 of 1979 )).

6. The District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ), is hereby amended by the deletion in column (4) of the Schedule thereto at reference number 8 of "Cloghan" (inserted by the District Court Districts and Areas (Amendment) Order, 1979 ( S.I. No. 20 of 1979 )) and "205,".

7. Business transacted in the District Court which is initiated and not completed before the commencement of this Order shall be continued and completed as if this Order has been in force at the time at which such business had been initiated.

EXPLANATORY NOTE.

This Order provides for the abolition of the District Court Area of Cloghan and the amalgamation of the District Electoral Divisions which comprise that Area with the District Court Area of Kilcormac. The Order also provides for a variation in the present arrangements for the holding of sittings of the District Court in Kilcormac.
