EUROPEAN COMMUNITIES (PAINTS, ETC.) (CLASSIFICATION, PACKAGING AND LABELLING) (AMENDMENT) REGULATIONS, 1984.

I, RUAIRI QUINN, Minister for Labour, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purposes of giving effect to Commission Directive No. 81/916/EEC of 5 October 19811 and Council Directive No. 83/265/EEC of 16 May 19832 hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Paints, etc.) (Classification, Packaging and Labelling) (Amendment) Regulations, 1984.

2. These Regulations shall come into operation on the 23rd day of July, 1984.

3. The European Communities (Paints, etc.) (Classification, Packaging and Labelling) Regulations, 1980 ( S.I. No. 365 of 1980 ), are hereby amended by—

(a) the substitution of the following definition for the definition of "the Directive" in Regulation 3:

" 'the Directive' means Council Directive No. 77/728/EEC of 7 November 1977, as amended by Commission Directive No. 81/916/EEC of 5 October 1981 and Council Directive No. 83/265/EEC of 16 May 1983.",

(b) the insertion of the following Regulation after Regulation 4:

"4. (a) A person shall not place on the market dangerous preparations (paints, varnishes, printing inks, adhesives and similar products) unless their packages and fastenings comply with the provisions of Article 15 of Directive 67/548/EEC3 (inserted by Council Directive 79/831/EEC4).".

EXPLANATORY NOTE.

These regulations give effect to Commission Directive No. 81/916/EEC of 5 October, 1981 and Council Directive No. 83/265/EEC of 16 May, 1983, concerning the classification, packaging and labelling of paints, varnishes, printing inks, adhesives and similar products. These Directives provide for (1) amendments to Annex I and Annex II of Council Directive No. 77/728/EEC of 7 November, 1977 and (2) the harmonisation of Council Directive No. 77/728/EEC with Directive 73/173/EEC.
