S.I. No. 180/1983 - Garda Síochána (Promotion) (Amendment) Regulations, 1983.


I, MICHAEL NOONAN, Minister for Justice, with the approval of the Government and in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), hereby make the following regulations:

1. These Regulations may be cited as the Garda Síochána (Promotion) (Amendment) Regulations, 1983.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The Garda Síochána (Promotion) Regulations, 1960 ( S.I. No. 203 of 1960 ), are hereby amended by the substitution for Regulation 10 (3) (inserted by the Garda Síochána (Promotion) (Amendment) Regulations, 1970 ( S.I. No. 43 of 1970 )), of the following paragraph:

"(3) ( a ) Notwithstanding paragraph (1) of this Regulation, every member of the Garda Síochána

(i) who is of the rank of Sergeant or Station Sergeant, and

(ii) with respect to whom the Commissioner is satisfied that such Sergeant or Station Sergeant has given consistently meritorious service and possesses a competent degree of technical skill in the field of, motor engineering or in the field of radio communications, shall be eligible for promotion by the Commissioner, with the approval of the Minister for Justice, to the rank of Inspector to be in charge of the Garda Síochána Headquarters Vehicle workshops and garage or to the rank of Inspector in the Garda Síochána Radio Communications Section for the control of a particular field of operations within that Section, but before seeking such approval, the Commissioner shall appoint a board of members of the Garda Síochána, not below the rank of Chief Superintendent, to inquire into the qualifications and records of service of those eligible for the promotion and to interview them as to their general suitability and shall consider the report of such board on such inquiry and interview.

( b ) 'Inspector' in paragraph (2) of this Regulation shall not include Inspector in charge of the Garda Síochána Headquarters Vehicle workshops and garage or Inspector in the Garda Síochána Radio Communications Section".

EXPLANATORY NOTE.

These Regulations are for the purpose of enabling Sergeants with special technical qualifications, who have not passed the ordinary promotion examinations, to be selected and promoted to the rank of Inspector in the Garda Síochána Radio Communications Section for the control of a particular field of operations within that Section.
