SEANAD ELECTORAL (CHARGES OF RETURNING OFFICERS IN UNIVERSITY CONSTITUENCIES) ORDER, 1983.

I, ALAN M. DUKES, Minister for Finance, in exercise of the powers conferred on me by section 15 of the Seanad Electoral (University Members) Act, 1937 (No. 30 of 1937), hereby order as follows:

1. This Order may be cited as the Seanad Electoral (Charges of Returning Officers in University Constituencies) Order, 1983.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order "the Act" means the Seanad Electoral (University Members) Act, 1937 (No. 30 of 1937).

4. The scale of maximum charges for returning officers in university constituencies shall be the scale set out in the Schedule to this Order.

5. (1) The scale prescribed by this Order shall apply to any election to Seanad Eireann in a university constituency as regards which, pursuant to section 23(1) of the Act, a declaration is made by the returning officer after the commencement of this Order.

(2) The scale prescribed by the Seanad Electoral (Charges of Returning Officers in University Constituencies) Order, 1981 ( S.I. No. 236 of 1981 ), shall not apply to any election to Seanad Eireann as regards which, pursuant to section 23(1) of the Act, a declaration is made by the returning officer after the commencement of this Order.

SCHEDULE.

SCALE OF MAXIMUM CHARGES.

A (1) In a contested election.

( a ) To the returning officer for conducting the election and performing all the duties which a returning officer is required by law to perform, including the cost of all necessary legal assistance— - £206.00.

( b ) Clerical and other assistance, including the counting of the votes and miscellaneous outlay—

For every complete 100 electors or fraction thereof exceeding one-half on the register of electors — £16.18.

( c ) All postal services (including registration services) in relation to the issue and return of ballot papers — actual and necessary charges.

(2) In an uncontested election.

( a ) To the returning officer — one-half of the fee mentioned in paragraph (1)(a) of this provision.

( b ) Clerical and other assistance, including miscellaneous outlay — actual expenses as supported by vouchers, but not exceeding one-sixth of the sum which would be payable pursuant to paragraph (1)(b) of this provision had the election been contested.

B Returning officers' travelling expenses in connection with the conduct of the election — First Class railway expense or, where railway service is not available, actual and necessary cost, with subsistence allowance at such rate per night for not more than four nights if necessarily absent from home on account of duty as may be authorised from time to time by the Minister for Finance.
