EUROPEAN COMMUNITIES (NON-AUTOMATIC WEIGHING MACHINES) (AMENDMENT) REGULATIONS, 1982.

I, DESMOND O'MALLEY, Minister for Trade, Commerce and Tourism, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 73/360/EEC of 19th November, 1973,1 and Commission Directive No. 76/696/EEC of 27th July, 1976,2 hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Non-Automatic Weighing Machines) (Amendment) Regulations, 1982.

2. The following is hereby substituted for Regulation 5 (1) of the European Communities (Non-Automatic Weighing Machines) Regulations, 1979 ( S.I. No. 128 of 1979 ):

"(1) There shall be charged in respect of each non-automatic weighing machine submitted for EEC initial verification to an inspector under the Weights and Measures Acts, 1878 to 1961, or to an officer of the Institute for Industrial Research and Standards, a fee—

( a ) for the period commencing on the 1st day of July, 1982, and ending at the making of the European Communities (Non-Automatic Weighing Machines) Regulations, 1982, of £0.65, and

( b ) for the period commencing at the making of the European Communities (Non-Automatic Weighing Machines) Regulations, 1982, of £0.65 for the first 45,000 such machines so submitted since the 1st day of July, 1982 (including any such machines so submitted in the period referred to in subparagraph (a) of this paragraph), and of £0.45 for all subsequent such machines so submitted.".

EXPLANATORY NOTE.

These Regulations were made to set out a revised fee for the EEC initial verification of non-automatic weighing machines.
