CORAS IOMPAIR EIREANN SALARIED OFFICERS' AND CLERKS' (G.S.R.) SUPERANNUATION SCHEME (AMENDMENT) SCHEME, 1982. (CONFIRMATION) ORDER, 1982.

I, JOHN P. WILSON, Minister for Transport, in exercise of the powers conferred on me by Rule 54 (2) of the Coras Iompair Eireann Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme and Section 44 of the Transport Act, 1950 (No. 12 of 1950), as adapted by the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), hereby, after consultation with the Minister for the Public Service, order as follows:—

1. This Order may be cited as the Coras Iompair Eireann Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme (Amendment) Scheme, 1982 (Confirmation) Order, 1982.

2. The scheme set out in the Schedule to this Order (being a scheme submitted by the Board under Rule 54 (1) of the Coras Iompair Eireann Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme and amending that scheme) is hereby confirmed, and shall be deemed to have come into operation on the 1st day of March, 1981.

SCHEDULE

Coras Iompair Eireann, in exercise of the powers conferred on it by Rule 54 of the Coras Iompair Eireann Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme and Section 45 of the Transport Act, 1950 (No. 12 of 1950), hereby submits to the Minister the following Scheme:—

1. This Scheme may be cited as the Coras Iompair Eireann Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme (Amendment) Scheme, 1982.

2. The Coras Iompair Eireann Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme is hereby amended by the addition of the following paragraph to Rule 14:—

"(4) (a) A member of this scheme—

(i) who has at least ten years' contributing membership, and

(ii) whose services are dispensed with by the Board on or after the 1st day of March, 1981, and before the 1st day of March, 1985, because of redundancy arising from any scheme for the re-organisation, or the more economical operation, of any department of the Board's undertaking, and

(iii) who at the time his services are so dispensed with is at least 55 years and not more than 60 years of age (or, in the case of a female such member who has not opted for a retiring age of from 60 to 65 years of age, at least 50 years and not more than 55 years of age), may, if the Board so agrees, be granted the superannuation allowance provided for by paragraph (1) of this rule.

( b ) If an additional contribution to the Fund is required to meet the cost of providing a superannuation allowance granted by virtue of sub-paragraph (a) of this paragraph, it shall be contributed by the relevant member of this scheme or by the Board, or jointly by such member and the Board, as they may agree between them.

( c ) For the avoidance of doubt, in this paragraph "the Board" means Coras Iompair Eireann and "the Board's" shall be construed accordingly."

EXPLANATORY NOTE.

The purpose of the scheme is to provide for the reduction, under certain conditions, of the retiring ages prescribed in the existing scheme, to allow for voluntary early retirement on redundancy.
