CORAS IOMPAIR EIREANN SALARIED OFFICERS AND CLERKS (G.N.R., C.D.R. and I.R.C.H.) SUPERANNUATION (AMENDMENT) SCHEME (CONFIRMATION) ORDER, 1982.

I, JOHN P. WILSON, Minister for Transport, in exercise of the powers conferred on me by Article 4 of the Coras Iompair Eireann (Additional Powers) Order, 1977 ( S.I. No. 366 of 1977 ) and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), hereby, after consultation with the Minister for the Public Service, order as follows:—

1. This Order may be cited as the Coras Iompair Eireann Salaried Officers and Clerks' (G.N.R., C.D.R. and I.R.C.H.) Superannuation (Amendment) Scheme (Confirmation) Order, 1982.

2. In this Order "the amending scheme" means the scheme amending the Coras Iompair Eireann Salaried Officers and Clerks' (G.N.R., C.D.R. and I.R.C.H.) Superannuation Scheme prepared by the Board and submitted to the Minister under paragraph 3 (1) of the Coras Iompair Eireann (Additional Powers) Order, 1977 ( S.I. No. 366 of 1977 ), and set out in the Schedule to this Order.

3. The amending scheme is hereby confirmed and shall be deemed to have come into operation on the 31st day of December, 1978.

SCHEDULE

SALARIED OFFICERS AND CLERKS' (G.N.R., C.D.R. and I.R.C.H.) SUPERANNUATION SCHEME, 1977 (AMENDMENT) SCHEME, 1982.

1. Definitions:

In this amending Scheme "the existing Scheme" means the Superannuation Scheme confirmed and brought into operation by the Coras Iompair Eireann Salaried Officers and Clerks' (G.N.R., C.D.R. and I.R.C.H.) Superannuation Scheme, 1977 (Confirmation) Order, 1978 ( S.I. No. 339 of 1978 ).

The term "operative date" means the date prescribed by the Order confirming this amending Scheme as the date upon which this amending Scheme is to come into operation.

2. Amendment of the Existing Scheme:

The existing Scheme shall be amended with effect on and from the operative date in the following manner:—

(i) The word "or" at the end of paragraph (i) and paragraph (ii) in Rule 37 shall be deleted.

(ii) Paragraph (2) of Rule 38 shall be deleted and the following new paragraph (2) shall be substituted therefor:—

"(2) except in exceptional circumstances of serious ill health or where the aggregate benefits payable to the member under this scheme and any other scheme relating to his service with a Contributing Body by whom he is employed do not exceed the value of a pension of £52 per annum, the aggregation of the capital sum to which an annuity or part of an annuity is commuted with any other lump sum retirement benefit payable under the Scheme shall not exceed 3/80ths of the Members final annual salary before retirement for each year of service provided that in the case of an employee who has entered the service of the Contributing Body after the 25th anniversary of his birth this limitation may be raised to the extent approved by the Revenue Commissioners for the time being".

(iii) Rule 41, 42 and 43 of the existing Scheme shall be re-numbered to rules 42, 43 and 44. The following new rule 41 shall be inserted after rule 40:—

"41. Deduction of Tax

Tax at the appropriate rate shall be deducted from all payments, in refund of contributions or in commutation of any pension or part of a pension, to which section 21 or section 22 of the Finance Act, 1972 is applicable".

EXPLANATORY NOTE.

The purpose of the amending Scheme is to bring certain provisions of the existing scheme into line with the requirements of the Finance Act, 1972 in connection with the obtaining of approval by the Revenue Commissioners.
