S.I. No. 332/1981 - Road Traffic (Speed Limits) (County of Kilkenny) Regulations, 1981.


The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Kilkenny) Regulations, 1981.

Commencement.

2. These Regulations shall come into operation on the 28th day of September, 1981.

Interpretation.

3. In these Regulations save where the context otherwise requires “the Act” means the Road Traffic Act, 1961 ;

“road” means a public road;

“perimeter road” means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

“special speed limit” and “built-up area speed limit” have the meanings respectively assigned to them in Part IV of the Act;

“distance” means distance as measured along the centre line of a road.

Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby delared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

Revocation.

7. The Road Traffic (Speed Limits) (County of Kilkenny) Regulations, 1977 ( S.I. No. 399 of 1977 ) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Callan:—

(a) Upper Haggardsgreen, Lower Haggardsgreen, The Ballywalter Road.

(b) The Kilkenny Road for a distance of 228 metres from the town boundary.

(c) The Minnauns Road for a distance of 489 metres from the town boundary.

(d) The Coolagh Road between the town boundary and a point 92 metres south-east of its junction with the Clonmel Road.

(e) The Clonmel Road between the town boundary and a point 83 metres south-west of its junction with the Coolagh Road.

(f) Chapel Lane between its junction with the Carrabine Bridge Road and a point 41 metres north-west of its junction with Green Street.

(g) The Carrabine Bridge Road for a distance of 128 metres from the point where the town boundary intersects the northern side of the road.

(h) The laneway leading from the Carrabine Bridge Road to the King's River.

(i) Flaggy Lane between its junction with Upper Haggardsgreen and a point 28 metres west of its junction with Lower Bridge Street.

2. The following roads in the Borough of Kilkenny:—

(a) The Old Glendine Road, The Castleinch Road.

(b) The Castlecomer Road for a distance of 1, 188 metres from the borough boundary.

(c) College Road and its continuation as the Callan Road for a distance of 600 metres from the borough boundary.

(d) The Circular Road between the borough boundary and a point 18 metres south-east of its junction with the Castleinch Road.

(e) The Ballycallan Road for a distance of 164 metres from the borough boundary.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ballyhale:—

(a) The Kilkenny-Waterford road between a point 26 metres south of its junction with the Station Road and a point 350 metres south of its junction with the Coolmore Road.

(b) The Coolmore Road for a distance of 46 metres from its junction with the Kilkenny-Waterford road.

2. The following roads at Ballyragget:—

(a) The Square, The Fair Green.

(b) Castle Street and its continuation as the Kilkenny Road for a distance of 875 metres from the junction of Castle Street with the Square.

(c) High Street and its continuation as the Castlecomer Road for a distance of 366 metres from the junction of High Street with Patrick Street.

(d) Patrick Street and its continuation as Smith's Road for a distance of 120 metres from the junction of Patrick Street with High Street.

(e) Moat Street and its continuation as the Moatpark Road between the junction of Moat Street with the Square and a point 128 metres north of the junction of the Moatpark Road with the Fair Green.

(d) The Maddockstown Road for a distance of 175 metres from its junction with the Gowran Road.

(e) The Link Road between the Maddockstown Road and the Gowran Road.

(f) The Annamuit Road for a distance of 125 metres from its junction with the Kilkenny Road.

(g) The Danesfort Road for a distance of 65 metres from its junction with the Annamult Road.

(h) The Tullaherin Road for a distance of 290 metres from its junction with the Thomastown Road.

4. The following roads adjacent to the town of Callan:—

(a) Fair Green Lane.

(b) Mill Street and its continuation as the Dunnamaggan Road for a distance of 137 metres from the point where the boundary of the town of Callan intersects the north-eastern side of the road.

(c) The easternmost laneway leading from Mill Street to the King's River.

5. The following roads at Castlecomer:—

(a) Market Lane, Market Square, Mill Lane, The Glebe, Love Lane, Maryville Housing Scheme Roads, Hospital Lane, Donaguille Road, New Housing Scheme Road.

(b) The Kilkenny-Dublin road between a point 11.0 metres south of its junction with Hospital Lane and a point 480 metres east of its junction with Barrack Street.

(c) Barrack Street and its continuation as the Ballyragget Road between the junction of Barrack Street with the Kilkenny-Dublin road and a point 183 metres north-west of the junction of the Ballyragget Road with Love Lane.

(d) The Old Road between its junction with the Ballyragget Road and a point 20 metres west of its western junction with the Glebe.

(e) Chatsworth Row between its junction with the Kilkenny-Dublin road and a point 32 metres south of its junction with the Skehana Road.

7. The following roads at Dunnamaggan:—

(a) The Callan-Knocktopher road between a point 110 metres north-west of its junction with the Raheen Road and a point 735 metres south-east of the said junction.

(b) The Raheen Road for a distance of 35 metres from its junction with the Callan-Knocktopher road.

8. The following roads at Fiddown:—

(a) The Waterford-Carrick-on-Suir road between a point 28 metres north of its junction with the Strand Road and a point 430 metres north-west of its junction with the Rathmore Road.

(b) The Rathmore Road for a distance of 295 metres from its junction with the Waterford-Carrick-on-Suir road.

9. The following roads at Freshford:—

(a) The Square.

(b) The Kilkenny-Thurles road between a point 115 metres south-east of its junction with the Clintstown Road and a point 211 metres west of its junction with Bohergloss Street.

(c) The Clintstown Road for a distance of 37 metres from its junction with the Kilkenny-Thurles road.

(d) The Moat Road for a distance of 95 metres from its junction with the Uppercourt Road.

(b) The Borris-Gowran road between the centre point of the Barrow Bridge and a point 348 metres west of its junction with Barrack Street.

(c) Barrowmount Road for a distance of 183 metres from its junction with the Borris-Gowran road.

12. The following roads at Gowran:

All roads in the area enclosed by a line commencing at a point on the Carlow Road 251 metres north of its junction with the Thomastown Road and drawn thence in straight lines successively to the following points:—

(a) the northwesternmost point of the Fairview Cottages Road,

(b) a point on the Killeen Road 86 metres north of its junction with the Fairview Cottages Road,

(c) a point on the Ullard Road 348 metres north-east of its junction with Barrow Lane,

(d) the easternmost point of the Quay,

(e) the centre point of Graiguenamanagh Bridge,

(f) a point on the New Ross Road 180 metres south of its junction with the Inistioge Road,

(g) a point on the Inistioge Road 51 metres west of its junction with the New Ross Road,

16. The following roads at Kells:

(a) The Kilkenny-Kilmaganny road between a point 25 metres north-west of its junction with the Ennisnag Road and a point 270 metres north-west of its junction with the Stoneyford Road.

(b) The Haggard Road for a distance of 135 metres from its junction with the Kilkenny-Kilmaganny road.

(c) The Stoneyford Road between its junction with the Kilkenny-Kilmaganny road and a point 30 metres east of its junction with the Kilree Road.

17. The following roads adjacent to the Borough of Kilkenny:

(a) The Mount Brilliant Road, The New Road, The Old Golf Links Road, The Newpark Cottages Road, Lover's Lane, Asylum Lane, Coote's Lane, Park View Road, O'Loughlin Road, Glendine Heights Housing Estate Roads.

(b) The Kilkieran Road for a distance of 46 metres from its junction with the Old Golf Links Road.

(b) a point on the Graiguenamanagh Road 183 metres north-east of its junction with the Inistioge Road,

(c) a point on the Inistioge Road 230 metres south-east of its junction with the Graiguenamanagh Road,

(a) St. Mary's Terrace.

(b) The Dublin-Cork road between a point 92 metres north-east of its junction with the Kilkenny Road and a point 230 metres south-west of its junction with the Killenaule or Gortnahoe Road.

(c) The Killenaule or Gortnahoe Road for a distance of 335 metres from its junction with the Dublin-Cork road.

(d) The New Line for a distance of 183 metres from its junction with the Dublin-Cork road.

(e) Lumper Lane for a distance of 125 metres from its junction with the Dublin-Cork road.

(f) The Kilkenny Road for a distance of 92 metres from its junction with the Dublin-Cork road.

(g) Mill Street and its continuation as the Island Road for a distance of 211 metres from the junction of Mill Street with the Dublin-Cork road.

31. The following roads adjacent to the County Borough of Waterford:—

(a) The Kilkenny or Dublin Road for a distance of 55 metres from the point where the boundary of the county borough of Waterford intersects the northern side of the road.

(b) The Rockshire Road between the boundary of the county borough of Waterford and a point 46 metres north of its junction with the Smartscastle Road.

(c) The Smartscastle Road for a distance of 275 metres from its junction with the Rockshire Road.

(d) The New Ross Road for a distance of 183 metres from the point where the boundary of the county borough of Waterford intersects the south-eastern side of the road.

(e) The Abbey Road for a distance of 101 metres from the boundary of the county borough of Waterford.

(f) The Golf Links Road for a distance of 610 metres from its junction with the Waterford-Kilkenny road.

32. The following road at Windgap:—

The Callan-Carrick-on-Suir road between a point 245 metres south-east of Windgap crossroads and a point 150 metres north-west of the said crossroads.

THIRD SCHEDULE.

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads at Boherboy and Paulstown:—

(a) The Carlow-Kilkenny road between a point 770 metres north-east of its junction with the Kellymount Road and a point 225 metres south-west of said junction.

(b) The Waterford Road for a distance of 515 metres from its junction with the Carlow-Kilkenny road.

(c) The Goresbridge Road between its junction with the Carlow-Kilkenny road and a point 670 metres east of the said junction.

(d) The Kellymount Road for a distance of 40 metres from its junction with the Carlow-Kilkenny road.

2. The following roads at Callan:—

(a) The Clonmel Road between a point 83 metres south-west of its junction with the Coolagh Road and point 320 metres south-west of the said junction.

(b) The Kilkenny Road between a point 385 metres north-east of the town boundary and a point 228 metres south-west of the said boundary.

(c) Upper Haggardsgreen for a distance of 10 metres from its junction with the Kilkenny Road.

3. The following roads at Castlecomer:—

(a) The Waterford-Carlow road between a point 80 metres north-west of its junction with the Bramblestown Road and a point 205 metres south-west of the said junction.

(b) The Bramblestown Road between its junction with the Waterford-Carlow road and a point 25 metres north-east of its junction with the Coppanagh Road.

(c) The Coppanagh Road for a distance of 25 metres from its junction with the Bramblestown Road.

5. The following road at Graiguenamanagh:—

The New Ross Road between a point 180 metres south of its junction with the Inistioge Road and a point 545 metres south of the said junction.

6. The following roads at Johnstown:—

(a) The Cork Road between a point 220 metres south-west of its junction with the Square and a point 700 metres south-west of the said junction.

(b) The Rathdowney Road for a distance of 395 metres from its junction with the Canal Road.

7. The following roads in and adjacent to the Borough of Kilkenny:—

(a) The Castlecomer Road between a point 1,188 metres south-east of the boundary of the borough of Kilkenny and a point 606 metres north of its junction with the New Glendine Road.

(a) The Kilkenny or Dublin Road between a point 55 metres west of the point where the boundary of the county borough of Waterford intersects the northern side of the road and a point 343 metres north of its junction with the Newrath Road.

(b) The New Ross Road between a point 183 metres north-east of the point where the boundary of the county borough of Waterford intersects the south-eastern side of the road and a point 375 metres south-west of the junction of the Kilmacow Road with the New Ross-Waterford road at Slieverue.

(c) The Abbey Road between a point 101 metres from the boundary of the county borough of Waterford and a point 1,735 metres from the said boundary.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Kilkenny) Regulations, 1977 ( S.I. No. 399 of 1977 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are expected from all speed limits by the Regulations.
