FINANCE ACT, 1979 (SECTION 5) ORDER, 1979.

I, SEOIRSE Ó COLLA, Minister for Finance, in exercise of the powers conferred on me by section 5 of the Finance Act, 1979 (No. 11 of 1979), hereby order as follows:

1. This Order may be cited as the Finance Act, 1979 (Section 5) Order, 1979.

2. The 23rd day of November, 1979, is hereby appointed as the day on which section 5 of the Finance Act, 1979 (No. 11 of 1979 ), shall come into operation.

3. It is hereby directed that, in determining cumulative tax-free allowances for the purposes of the Income Tax (Employment) Regulations, 1960 ( S.I. No. 28 of 1960 ), the date on which deductions under the said section 5 shall be deemed to have accumulated in full shall be the said 23rd day of November, 1979.

EXPLANATORY NOTE

This Order brings section 5 of the Finance Act, 1979 , into operation. That section provides for a deduction of £175 from total income for income tax purposes in the case of each taxpayer (excepting proprietory directors and similar employees) to whom the PAYE system applies, or a deduction equal to the amount of the income subject to PAYE, if this is less than £175. The commencement date for the operation of section 5 is the 23rd of November, 1979, and the deductions provided for under the section will be deemed to have accumulated in full for PAYE purposes on that date. Where husband and wife are both within PAYE, each may qualify for a separate deduction of £175.
