SOCIAL WELFARE (ASSISTANCE) REGULATIONS, 1979.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 , 29 , 47 , 84 and 121 of the Social Welfare Act, 1952 (No. 11 of 1952), section 22 of the Social Welfare Act, 1970 (No. 12 of 1970) section 8 of the Social Welfare Act, 1973 (No. 10 of 1973) and sections 8 and 9 of the Social Welfare (No. 2) Act, 1974 (No. 14 of 1974), hereby makes the following Regulations.

1. These Regulations may be cited as the Social Welfare (Assistance) Regulations, 1979.

2. These Regulations shall apply in respect of a pension under the Old Age Pensions Acts, 1908 to 1979, widow's (non-contributory) pension, orphan's (non-contributory) pension, deserted wife's allowance, social assistance allowance under section 8 of the Social Welfare Act, 1973 single woman's allowance and prisoner's wife's allowance.

3. Articles 9 (2), 9 (3) and 10 (2) of the Social Welfare (Claims and Payments) Regulations, 1952 ( S.I. No. 374 of 1952 ), as amended by articles 6 and 7 of the Social Welfare (Claims and Payments) (Amendment) Regulations, 1960 ( S.I. No. 259 of 1960 ), shall apply in respect of the pensions and allowances referred to in article 2 of these Regulations as if the references in those articles to pension or maternity allowance included a reference to such pensions and allowances.

EXPLANATORY NOTE.

These Regulations extend to old age pensions, widow's (non-contributory) pensions, orphan's (non-contributory) pensions, deserted wife's allowances, unmarried mother's allowances, single women's allowances and prisoner's wife's allowances the provisions of Articles 9 (2), 9 (3) and 10 (2) of the Social Welfare (Claims and Payments) Regulations 1952 as amended by the Social Welfare (Claims and Payments) (Amendment) Regulations, 1960. The effect is to provide that in certain circumstances the time for making a claim for these pensions may be extended to the date of the making of the claim.
