SOCIAL WELFARE (EMPLOYMENT OF INCONSIDERABLE EXTENT) REGULATIONS, 1979.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of and paragraph 6 of Part II of the First Schedule to the Social Welfare Act, 1952 (No. 11 of 1952 ), hereby makes the following Regulations:—

1. These Regulations may be cited as the Social Welfare (Employment of Inconsiderable Extent) Regulations, 1979.

2. These Regulations shall come into operation on the 6th day of April, 1979.

3. In these Regulations—

"systematic short-time employment" employment in accordance with a system of short-time working arrangements within a firm or undertaking in which the normal working week is in excess of 18 hours and where the employed person is employed on a lesser number of hours in a working week than is normal to the working week in that employment in that firm or undertaking.

4. Each of the following employments is hereby specified as being employment of inconsiderable extent:—

( a ) Employment (which apart from these Regulations would be insurable) in one or more employments (other than systematic short-time employment) for less than eighteen hours in a contribution week where the employed person is not mainly dependent for his livelihood on the remuneration received for such employment or employments.

( b ) Employment (which apart from these Regulations would be insurable) in respect of which the rate of remuneration of the employed person does not exceed a rate equivalent to a rate of £6 a week, or £26 a month, where the employed person has no other employment.

5. The Social Welfare (Employment of Inconsiderable Extent) (No. 2) Regulations, 1953 ( S.I. No. 290 of 1953 ) are hereby revoked.

EXPLANATORY NOTE.

These Regulations revoke the Social Welfare (Employment of Inconsiderable Extent) Regulations ( S.I. No. 290 of 1953 ), and specify as employment of inconsiderable extent (a) employment, in one or more employments, the total duration of which is less than 18 hours in a week, where the employee is not mainly dependent on the earnings from the employment or employments, as the case may be, and (b) employment, where the employee has only one job for which the rate of earnings does not exceed a rate of £6 a week, or £26 a month. Such employments are excepted from liability for social insurance contributions but under the provisions of the Social Welfare (Occupational Injuries) Act, 1966 , a contribution is payable in respect of occupational injury benefit.
