CUSTOMS (LAND FRONTIER) REGULATIONS, 1978.

I, SEOIRSE Ó COLLA, Minister for Finance, in exercise of the powers conferred on me by section 13 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Customs (Land Frontier) Regulations, 1978.

(2) The Customs (Land Frontier) Regulations, 1968 ( S.I. No. 117 of 1968 ), and these Regulations shall be construed together and may be cited together as the Customs (Land Frontier) Regulations, 1968 and 1978.

2. These Regulations shall come into operation on the 1st day of December, 1978.

3. The Customs (Land Frontier) Regulations, 1968, are hereby amended as follows:

( a ) the insertion after Article 6 of the following Article—

"6A. Save as is otherwise provided in these Regulations, no person shall import or export, or attempt to import or export, or be concerned in the importation or exportation of, or in an attempt to import or export, any goods by an approved route other than during official hours.";

( b ) the insertion in Article 8 after "or Frontier Post" of "or class of goods";

( c ) the substitution in paragraph (a) of Part 1 of the First Schedule thereto for "for the importation of goods of every description" of "for the importation of goods of every description except live sheep and lambs"; and

( d ) the insertion after Part IV of the First Schedule thereto of the following Part:—

EXPLANATORY NOTE.

These Regulations amend the Customs (Land Frontier) Regulations, 1968 ( S.I. No. 117 of 1968 ) by the following:

Article 3 (2) inserts a new Article 6A to the Customs (Land Frontier) Regulations, 1968 which places beyond doubt that the movement of goods across the Land Frontier by an approved route but outside official hours is an offence.

Article 3 (b) empowers the Revenue Commissioners to prescribe specific days and hours of opening of Stations/Posts for specific classes of goods.

Article 3 (c) excludes live sheep and lambs from goods which can be imported at the 15 Posts mentioned.

Article 3 (d) introduces a new Schedule to provide for the importation of live sheep and lambs and confines such imports to the five routes specified.
