MEMBERS OF THE OIREACHTAS AND MINISTERIAL AND PARLIAMENTARY OFFICES (ALLOWANCES AND SALARIES) ORDER, 1978.

The Government, in exercise of the powers conferred on them by section 3A of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938) (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 4 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977), and section 8A of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938) (inserted by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 7 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 hereby make the following Order.

1. This Order may be cited as the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1978.

2. In this Order—

"the Act of 1938" means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

"the Act of 1973" means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

"the Act of 1977" means the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977);

"the Agreement" means the Employer Trade Union National Agreement, 1978, of the Employer-Labour Conference ratified on the 23rd day of March, 1978.

3. The Allowance payable monthly under section 3 of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), as amended by section 4 of the Act of 1973, to each member of Dáil Eireann, and the allowance so payable under the said section 3 as so amended, to each member of Seanad Éireann shall be and be deemed to have been increased—

( a ) with effect from the 1st day of March, 1978, by an amount calculated in accordance with Clause 3(c) of the Agreement,

( b ) with effect from the 1st day of March, 1979, by an amount calculated in accordance with Clause 3(d) of the Agreement.

4. The annual sum payable under section 9A of the Act of 1938 (inserted by section 13 of the Act of 1973) or section 10 of the Act of 1938, as amended by section 14 of the Act of 1973, by way of allowance for expenses,

( a ) with effect from the 1st day of March, 1978, shall be and be deemed to have been,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £19,809,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £13,866,

(iii) in case any such sum is payable under paragraph (b) of subsection (2) of the said section 9A, £5,943,

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £9,905,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £9,905 divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £49,533,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £34,672,

(viii) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (2) £14,861,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £24,767, and

(x) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (3), £24,767 divided in the manner specified in that paragraph,

( b ) with effect from the 1st day of March, 1979, shall be and be deemed to have been,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £20,205,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £14,143,

(iii) in case any such sum is payable under paragraph (b) of the said subsection (2) £6,062,

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £10,103,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £10,103, divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £50,524,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £35,365,

(viii) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (2) £15,158,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £25,262,

(x) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (3), £25,262, divided in the manner specified in that paragraph.

5. (1) Each of the annual sums specified in paragraph (2) of this Article shall be and be deemed to have been increased—

( a ) with effect from the 1st day of March, 1978, by an amount calculated in accordance with Clause 3(c) of the Agreement,

( b ) with effect from the 1st day of March, 1979, by an amount calculated in accordance with Clause 3(d) of the Agreement.

(2) The annual sums referred to in paragraph (1) of this Article are—

( a ) any annual sum payable by way of salary under subsection (1) (inserted by section 7 of the Act of 1973) or subsection (2) (inserted by section 6 of the Act of 1977) of section 3 of the Act of 1938,

( b ) the annual sum so payable under section 4 of the Act of 1938 (inserted by section 8 of the Act of 1973) (whether the person concerned is a member of the Oireachtas or not),

( c ) any annual sum so payable under section 5(1) of the Act of 1938 (inserted by section 9 of the Act of 1973), and

( d ) any annual sum so payable under section 6(1) of the Act of 1938 (inserted by section 10 of the Act of 1973).

EXPLANATORY NOTE.

This order gives to Parliamentarians and Office Holders the standard increases due under the Employer-Labour National Agreement, 1978.
