SOCIAL WELFARE (SOCIAL ASSISTANCE ALLOWANCE) (AMENDMENT) REGULATIONS, 1978.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) and section 8 of the Social Welfare Act, 1973 (No. 10 of 1973), hereby makes the following Regulations:

1. These Regulations may be cited as the Social Welfare (Social Assistance Allowance) (Amendment) Regulations, 1978.

2. These Regulations and the Social Welfare (Social Assistance Allowance) Regulations, 1973 ( S.I. No. 190 of 1973 ) may be cited collectively as the Social Welfare (Social Assistance Allowance) Regulations, 1973 and 1978.

3. These Regulations shall come into operation on the 1st day of April, 1978.

4. Article 6 of the Social Welfare (Social Assistance Allowance) Regulations, 1973 is hereby revoked.

5. Article 8 of the Social Welfare (Social Assistance Allowance) Regulations, 1973 is hereby amended by the substitution in subarticle (1) for the words "and 63." of the words ", 63 and 80 (2)." and by the insertion after sub-article (3) of the following sub-article—

"(4) In the application of section 80 (2) of the said Act any reference to 'widows' (non-contributory) pension under the Widows' and Orphans' Pensions Acts, 1935 to 1952' shall be construed as including an allowance."

EXPLANATORY NOTE.

These Regulations amend the Social Welfare (Social Assistance Allowance) Regulations, 1973 by providing that a person applying for a social assistance allowance does not have to satisfy a residence test and that a person who, immediately before attaining pension age, is in receipt of a social assistance allowance shall not be required to satisfy the residence conditions for old age (non-contributory) pensions purposes imposed by section 2 of the Old Age Pensions Act, 1932 .
