HARBOUR RATES (BALLINA HARBOUR) ORDER, 1978.

I, PÁDRAIG FAULKNER, Minister for Tourism and Transport, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ) and the Transport and Power (Alteration of Name of Department and Title of Minister) Order. 1977 ( S.I. No. 305 of 1977 ), and after due compliance with section 106 of that Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Ballina Harbour) Order, 1978.

(2) This Order shall come into operation on the 31st day of March, 1978.

2. The Moy Navigation Amendment Act, 1860, shall be construed and have effect as if—

( a ) for the matter contained in Schedule B (as amended by the Ballina Port and Harbour (Temporary Increase of Charges) Order, 1921, and the Harbour Rates (Ballina Harbour) Order, 1950 ( S.I. No. 279 of 1950 )) to that Act there were substituted the matter contained in the First Schedule to this Order, and

( b ) for the matter contained in Schedule C (as amended by the Ballina Port and Harbour (Temporary Increase of Charges) Order, 1921, and the Harbour Rates (Ballina Harbour) Order, 1950) to that Act there were substituted the matter contained in the Second Schedule to this Order.

3. The Harbour Rates (Ballina Harbour) Order, 1950, is hereby revoked.

( a ) On every ton of net register tonnage or of half of the gross tonnage, whichever is the greater, of every vessel (except as hereinafter provided) entering the harbour for the purpose of shipping, transhipping or discharging cargo, or cargo and passengers, a sum not exceeding

Tonnage rates on fishing vessels of over 15 metres overall as a composition in full in lieu of tonnage rates on every fishing vessel engaged in fishing entering the harbour, per trip

EXPLANATORY NOTE.
