WILDLIFE ADVISORY COUNCIL ORDER, 1978.

I, BRIAN LENIHAN, Minister for Fisheries, in exercise of the powers conferred on me by section 13 of the Wildlife Act, 1976 (No. 39 of 1976), as adapted by the Lands (Alteration of Name of Department and Title of Minister) Order, 1977, ( S.I. No. 29 of 1977 ), hereby with the consent of the Minister for the Public Service in so far as the following enables allowances to be paid, order as follows:

1. This Order may be cited as the Wildlife Advisory Council Order, 1978.

2. In this Order "the Minister" means the Minister for Fisheries.

3. The body to be known in the Irish language as An Chomhairle um Fhiadhúlra and in the English language as The Wildlife Advisory Council is hereby established, and such body is in this Order subsequently referred to as "the Council".

4. (1) The Council shall consist of not more than 35 members (including the chairman).

(2) The Minister shall from time to time as occasion may require appoint a member of the Council to be the chairman thereof.

5. The term of office of a member of the Council shall be such period not exceeding three years as the Minister shall fix when appointing him.

6. (1) Any member of the Council who has become incapable through ill-heath or otherwise of effectively performing his duties or whose removal appears to the Minister to be necessary for the effective performance by the Council of its functions may be removed from office by the Minister.

(2) The Chairman or any ordinary member of the Council may at any time resign his office by letter addressed to the Minister.

7. A member of the Council whose term of office expires otherwise than by reason of his removal from office shall be eligible for reappointment.

8. Where a casual vacancy occurs among the members of the Council, the Minister may take the steps necessary to fill the vacancy.

9. The Council shall meet—

( a ) at such time as may be determined by the Council;

( b ) at such time as it may be requested by the Minister to meet;

( c ) at such times as may be specified in a requisition in that behalf signed by at least fifteen members of the Council and received by the secretary to the Council.

10. The Minister shall fix the date, time and place of the first meeting of the Council.

11. The Minister shall appoint one of his officers to act as secretary to the Council.

12. Meetings of the Counil shall be called by a notice sent by the secretary to the Council to each member of the Council.

13. The quorum for a meeting of the Council shall be such as shall be fixed for the time being by the Council.

14. Subject to the provisions of section 13 of the Wildlife Act, 1976 , and Article 13 of this Order, the Council may regulate the business and procedure of the Council.

15. The Council may act notwithstanding one or more than one vacancy among its members.

16. The Minister may pay to a member of the Council attending a meeting of the Council an allowance in respect of his travelling and subsistence expenses and such allowance shall be in accordance with amounts approved for the time being for the purposes of this Order by the Minister for the Public Service.

EXPLANATORY NOTE.

This Order establishes the Wildlife Advisory Council pursuant to Section 13 of the Wildlife Act, 1976 and provides for such matters as the constitution of the Council, the tenure of office of its members and other ancillary matters.
