EMPLOYMENT EQUALITY ACT, 1977 (SECTION 28) REGULATIONS, 1977.

I, GENE FITZGERALD, Minister for Labour, in exercise of the powers conferred on me by section 28 of the Employment Equality Act, 1977 (No. 16 of 1977), hereby make the following Regulations :

1. These Regulations may be cited as the Employment Equality Act, 1977 (Section 28) Regulations, 1977, and shall come into operation on the 2nd day of November, 1977.

2. In these Regulations "the Act" means the Employment Equality Act, 1977 (No. 16 of 1977).

3. The form set out in Schedule 1 to these Regulations is hereby prescribed as the form to be used for the purposes of section 28 of the Act by a person (hereinafter called "the employee") proposing to refer under section 19 of the Act a dispute to the Labour Court and proposing to ascertain from the other person concerned the reason for the act believed by the employee to have constituted discrimination under the Act.

4. The form set out in Schedule 2 to these Regulations is hereby prescribed as the form to be used for the purposes of section 28 of the Act by a person when stating the reason for an act believed by another person to have constituted discrimination under the Act.

5. A person stating reasons under section 28(1) of the Act shall do so not later than 21 days from the date of service of the request for the reasons.

NOTE: Under section 28 of the Employment Equality Act, 1977 , a person may ascertain from another person the reasons for an act done by that other person and believed by the first-mentioned person to have constituted discrimination under that Act, and that other person is obliged by that section to state the reason in writing to the first-mentioned person.

EXPLANATORY NOTE.

These regulations prescribe the forms to be used for the purposes of Section 28 of the Employment Equality Act, 1977 by a person who proposes to refer a dispute under Section 19 of the Act to the Labour Court and who wishes to ascertain the reason for an act believed to be discriminatory.

Article 5 of the Regulations prescribes the time limit for the completion and return of the forms.
