ROAD TRAFFIC (PUBLIC SERVICE VEHICLES) (AMENDMENT) (No. 4) REGULATIONS, 1977.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 82 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Amendment) (No. 4) Regulations, 1977.

(2) The Road Traffic (Public Service Vehicles) Regulations, 1963 to 1977 and these Regulations shall be construed together and the expression the Road Traffic (Public Service Vehicles) Regulations, 1963 to 1977 shall include these Regulations.

2. Article 3 of the Road Traffic (Public Service Vehicles) (Amendment) (No. 3) Regulations, 1977 ( S.I. No. 268 of 1977 ) is hereby amended by the insertion after the word "use" of the words "in a taximeter area".

3. (1) Notwithstanding anything contained in the Road Traffic (Public Service Vehicles) Regulations, 1963 to 1977 on and after the date of the making of these Regulations an application by a person for the grant of a small public service vehicle licence in respect of the use, in an area other than a taximeter area, of a vehicle as a public hire vehicle may be made only in the period from the first to the fourteenth day inclusive of the month of September in any year unless the application is made by a person who at any time in the period of twelve months preceding the date of application held such a licence in respect of a vehicle, and the application is made for the purpose of licensing the said vehicle or another vehicle to replace the said vehicle and the licence in respect of the said vehicle has ceased to be in force through effluxion of time or shall have been surrendered or revoked on or before the grant of the licence for which the application is made.

(2) Where a small public service vehicle licence is granted on an application made pursuant to this article, a person shall not use the vehicle in respect of which the licence is granted as a public hire vehicle in a taximeter area.

EXPLANATORY NOTE.

These Regulations provide that—

( a ) an application for the grant of a small public service vehicle in respect of the use, in an area other than a taximeter area, of a vehicle as a public hire vehicle may be made only in the period from the first to the fourteenth day inclusive of September in any year unless the applicant satisfies specified conditions; and

( b ) a vehicle so licenced shall not be used in a taximeter area.
