NATIONAL AGRICULTURAL AUTHORITY (NOMINATION OF MEMBERS OF THE BOARD) ORDER, 1977.

I, MARK CLINTON, Minister for Agriculture, in exercise of the powers conferred on me by section 26 (3) of, and paragraph 6 of the Second Schedule to, the National Agricultural Advisory, Education and Research Authority Act, 1977 (No. 13 of 1977), hereby order as follows:

1. This Order may be cited as the National Agricultural Authority (Nomination of Members of the Board) Order, 1977.

2. In this Order—

"the Act" means the National Agricultural Advisory, Education and Research Authority Act, 1977 (No. 13 of 1977);

"the Authority" means the Authority to be established under section 9 of the Act;

"the Board" means the Board to be established under section 25 of the Act;

"the Minister" means the Minister for Agriculture;

"the Secretary" means the Secretary of the Department of Agriculture.

3. For appointment by the Minister as the remaining members of the Board in accordance with section 26 of the Act, there shall be nominated by the bodies mentioned in column (2) of the Schedule to this Order, as representative of the interests mentioned in column (1) of that Schedule opposite the mention of such body or bodies, a number of persons not exceeding the number mentioned in column (3) of that Schedule opposite the mention of each such interest.

4. (1) A person may be nominated under Article 3 of this Order by a body or bodies, as the case may be—

( a ) by sending by registered post addressed to the Secretary, or

( b ) by delivering by hand at the office of the Department of Agriculture, Agriculture House, Kildare Street, Dublin 2,

so as to reach the Secretary within the time fixed for the receipt of nominations under paragraph (2) of this Article, a nomination made in respect of the interest concerned of that person which complies with the provisions of this Order.

(2) The following provisions shall apply in respect of the nominations:

( a ) the Minister shall fix the time for the receipt of nominations (other than nominations made in respect of the staff of the Authority) and the Secretary shall notify the nominating bodies of such time;

( b ) each nomination shall be in writing signed by a person authorised in that behalf by the body or bodies who made the nomination;

( c ) each nomination shall contain the full name, address and occupation of the person nominated and the description and address of the body or of each of the bodies who made the nomination;

( d ) the nominations in respect of the staff of the Authority shall be made not later than the 1st day of March, 1978.

5. A casual vacancy occuring among the members of the Board shall be filled on the nomination of the body or bodies on whose nomination the appointment of the member whose death, resignation, removal from office or disqualification caused the vacancy, and the provisions of Article 3 of this Order, in so far as they are applicable, shall apply to the filling of such vacancy.

EXPLANATORY NOTE.

The Order specifies the organisations named in the Schedule as organisations which shall on behalf of the interests named in the Schedule nominate persons to be appointed as members of the Board of the National Agricultural Authority in accordance with Section 26 (3) of the National Agricultural Advisory, Education and Research Authority Act, 1977 , and also sets out the maximum number of persons that may be nominated on behalf of each interest concerned and the manner in which the nominations shall be made.
