EUROPEAN COMMUNITIES (BEET SEED) REGULATIONS, 1977.

I, MARK CLINTON, Minister for Agriculture, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive No. 76/331/EEC of 29th March, 1976, hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Beet Seed) Regulations, 1977.

(2) The Principal Regulations and these Regulations shall be construed as one and may be cited together as the European Communities (Beet Seed) Regulations, 1976 and 1977.

2. In these Regulations—

"the Commission Directive" means Commission Directive No. 76/391/EEC of 29th March, 1976;1

"the Principal Regulations" means the European Communities (Beet Seed) Regulations, 1976 ( S.I. No. 230 of 1976 ).

3. The definition of "the directive" contained in Regulation 2 (1) of the Principal Regulations shall be construed and have effect as if the reference to Council Directive No. 66 /400/EEC of 14th June, 1966,2 were a reference to that directive as amended as specified in that definition and by the Commission Directive.

4. The entry in the Schedule to the Principal Regulations comprising Annex I is hereby amended by—

( a ) as on and from the 1st day of July, 1978, the substitution for the table in Part A (5) of the following:

The percentage by weight of other seeds shall not exceed 0·3.

(1) Excluding, where appropriate, granulated pesticides, pelleting substances or other solid additives.

( c ) as on and from the last-mentioned 1st day of July, in Part B (3) (b),

(i) the addition of the following to heading (aa):

"The percentage of clusters giving three or more seedlings shall not exceed five, calculated on the germinated clusters.",

(ii) the addition of the following after heading (aa):

"(aa) (a) Precision seed of sugar beet:

At least 70% of the germinated clusters shall give single seedlings. The percentage of clusters giving three or more seedlings shall not exceed five, calculated on the germinated clusters.", and

(iii) the replacement of heading (bb) by the following:

"(bb) Precision seed of fodder-beet."

EXPLANATORY NOTE.

The Regulations—

(1) provide, as from 1st July, 1977, for higher standards for sugar-beet seed in respect of germination capacity and monogermity;

(2) provide, as from 1st July, 1978, for increased isolation distances from certain categories of beet crops from neighbouring beet seed crops.
