MEMBERS OF THE OIREACHTAS (ALLOWANCES) ORDER, 1977.

The Government, in exercise of the powers conferred on them by section 3A of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938) (inserted therein by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)) and section 8A of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938) (inserted therein by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 ), hereby make the following Order with respect to which, pursuant to the said section 3A and the said section 8A, a draft has been laid before Dáil Éireann and a resolution disapproving of the draft has not been passed by Dáil Éireann within the next subsequent twenty-one days on which it has sat after the draft was laid before it:

1. This Order may be cited as the Members of the Oireachtas (Allowances), Order, 1977.

2. In this Order—

"the Act of 1938" means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

"the Act of 1973" means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

"the Agreement of 1972" means the National Agreement, 1972, of the Employer-Labour Conference ratified on the 31st day of July, 1972;

"the Agreement of 1974" means the Employer-Trade Union National Agreement, 1974, of the Employer-Labour Conference ratified on the 7th day of March, 1974;

"the Agreement of 1975" means the Employer-Trade Union National Agreement, 1975, of the Employer-Labour Conference ratified on the 22nd day of April, 1975, and revised on the 24th day of September, 1975;

"the Agreement of 1976" means the Employer-Trade Union Interim National Agreement, 1976, of the Employer-Labour Conference ratified on the 16th day of September, 1976;

"the Agreement of 1977" means the Employer-Trade Union National Agreement, 1977, of the Employer-Labour Conference ratified on the 23rd day of February, 1977.

3. The allowance payable monthly under section 3 of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), as amended by section 4 of the Act of 1973, to each member of Dáil Éireann, and the allowance so payable under the said section 3 as so amended to each member of Seanad Éireann shall be and be deemed to have been increased—

( a ) with effect from the 1st day of January, 1977—

(i) by an amount calculated in accordance with Clause 3 ( f ) of the Agreement of 1975,

(ii) by an amount calculated in accordance with Clause 3 (b) of the Agreement of 1972, as applied by Clause 3(f) of the Agreement of 1974 and Clause 3 (d) of the Agreement of 1976, and

(iii) by an amount calculated in accordance with Clause 3 (b) of the Agreement of 1976,

( b ) with effect from the 1st day of April, 1977, by an amount calculated in accordance with Clause 3 (c) of the Agreement of 1977, and

( c ) with effect from the 1st day of November, 1977, by an amount calculated in accordance with Clause 3 (d) of the Agreement of 1977.

4. The annual sums payable under section 9A of the act of 1938 (inserted therein by section 13 of the Act of 1973) or section 10 of the act of 1938, as amended by section 14 of the Act of 1973, by way of allowance for expenses

( a ) with effect from the 1st day of January, 1977, shall be and be deemed to have been,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £17,156,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £12,009,

(iii) in case any such sum is payable under paragraph (b) of the said subsection (2), £5,147,

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £8,578,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £8,578 divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £42,898,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £30,029,

(viii) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (2), £12,869,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £21,449, and

(x) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (3), £21,449 divided in the manner specified in that paragraph,

( b ) with effect from the 1st day of April, 1977, shall be,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £17,740,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £12,418,

(iii) in case any such sum is payable under paragraph (b) of the said subsection (2), £5,322,

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £8,870,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £8,870 divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £44,356,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £31,050,

(viii) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (2), £13,306,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £22,178,

(x) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (3), £22,178 divided in the manner specified in that paragraph, and

( c ) with effect from the 1st day of November, 1977, shall be,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £18,342,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £12,839,

(iii) in case any such sum is payable under paragraph (b) of the said subsection (2), £5,503,

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £9,171,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £9,171 divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £45,864,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £32,104,

(viii) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (2), £13,760,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £22,932, and

(x) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (3), £22,932 divided in the manner specified in that paragraph.

EXPLANATORY NOTE.

This Order gives members of the Oireachtas the increases due under the National Agreements during 1976 and 1977. However, the increases due during 1976 are only being paid with effect from 1 January, 1977.
