HARBOUR RATES (YOUGHAL HARBOUR) ORDER, 1977.

I, TOM FITZPATRICK, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 159 of 1959 ), and after due compliance with section 106 of the said Act, hereby order as follows:

1. This Order may be cited as the Harbour Rates (Youghal Harbour) Order, 1977.

2. This Order shall come into operation on the 30th day of May, 1977.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. The Youghal Harbour Order, 1878, shall have effect as if, for Parts I and II of the Schedule thereto (inserted by the Harbour Rates (Youghal Harbour) Order, 1943 ( S. R. & O. No. 346 of 1943 )), as amended by the Harbour Rates (Youghal Harbour) Order, 1970 ( S.I. No. 190 of 1970 ), there were substituted the following—

I. Rates on Vessels.

1. On every ship, vessel or steamer (other than a yacht or other pleasure boat) entering the harbour to discharge or load cargo, on each occasion of entering the harbour, per net registered ton

2. On every ship, vessel or steamer (other than a yacht or other pleasure boat) entering the harbour for the purpose of seeking refuge, per net registered ton ... ... ... ...

3. On every ship, vessel or steamer (other than a yacht or other pleasure boat) entering the harbour unladen and using the docks or quays within the harbour for the purpose of repairs or cleaning, per net registered ton ... ... ...

5. On every yacht or other pleasure boat entering the harbour, payable in advance, on the 1st day of June in each year as a composition in full for one year of all tonnage rates mentioned in this Part of this Schedule if the gross weight of the yacht or other pleasure boat—

( a ) is less than one ton
