FOOD HYGIENE REGULATIONS, 1950 (SHELLFISH CONTROLLED AREA) ORDER, 1977.

The Minister for Health, in exercise of the powers conferred on him by Article 55 of the Food Hygiene Regulations, 1950 ( S.I. No. 205 of 1950 ) hereby orders as follows:—

1. This Order may be cited as the Food Hygiene Regulations, 1950 (Shellfish Controlled Area) Order, 1977.

2. This Order will come into operation on 1st day of May, 1977.

3. The area specified in the Schedule hereto is hereby declared to be a controlled area for the purposes of Part VI of the Food Hygiene Regulations, 1950.

SCHEDULE.

Controlled Area.

The portion of Castlemaine Harbour otherwise Castlemaine Haven including inlets and harbours, the strands and tidal waters of rivers forming part of the region of the Southern Health Board which lies inside a line drawn from Inch Point in the County of Kerry to Rossbehy Point in the County of Kerry.

EXPLANATORY NOTE.

The effect of this order is to declare the area of Castlemaine Harbour otherwise Castlemaine Haven inside a line drawn from Inch Point to Rossbehy Point, County Kerry, to be a controlled area for the purposes of Part VI of the Food Hygiene Regulations 1950. To sell, offer for sale or have possession of for the purpose of sale of shellfish for human consumption from this area is thereby prohibited unless treated in a manner approved by the local Director of Community Care and Medical Officer of Health. The local Director of Community Care and Medical Officer of Health is also empowered to approve, or withdraw approval, of sites for the relaying of shellfish and any person selling, offering for sale or having possession of for the purpose of sale is required to keep appropriate records.
