TELEX (AMENDMENT) REGULATIONS, 1977.

I, CONOR CRUISE O'BRIEN, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 2 of the Telegraph Act, 1885, and with the consent of the Minister for Finance, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Telex (Amendment) Regulations, 1977.

(2) In these Regulations "the 1955 Regulations" means the Telex Regulations, 1955 ( S.I. No. 229 of 1955 ).

(3) The Telex Regulations, 1955 to 1975, and these Regulations may be cited together as the Telex Regulations, 1955 to 1977.

2. These Regulations shall come into operation on the 1st day of April, 1977.

3. The interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. (1) The 1955 Regulations are hereby amended by—

(a) the substitution of Regulation 5 (1A) (inserted by Regulation 4 (c) of the Telex (Amendment) Regulations, 1974 ( S.I. No. 309 of 1974 )) of "15p" for "12p",

(b) the substitution in Regulation 29 of "46.5p" for "7s. 6d.", and

(c) the substitution of the following for the Schedule (inserted by the Telex (Amendment) Regulations, 1975 ( S.I. No. 311 of 1975 )):

"SCHEDULE.

PART I.

Charges for calls other than Subscriber Keyed Calls.

Description of Call

Charge

1. A call between two installations connected with the same telex exchange

5·25p for each three minutes or part of three minutes.

For the first three minutes or part of three minutes

For each minute or part of a minute after the first three minutes.

2. Any other call to an installation in Ireland, the distance between the telex exchanges connected for the purpose of the call being in excess of 80 kilometres

3. A call to an installation in Great Britain, the Isle of Man or the Channel Islands

PART II

Charges for Subscriber Keyed Calls.

The charge for a subscriber keyed call shall be the sum of 5·25p in respect of each period or part of a period of time specified in the Table to this part of this Schedule which is appropriate to the call and during which the call continues.

Description of Call

1. A call between two installations connected with the same telex exchange

2. Any other call to an installation in Ireland, the distance between the telex exchanges connected for the purpose of the call being in excess of 80 kilometres

3. A call to an installation in Great Britain, the Isle of Man or the Channel Islands.

(2) Regulation 5 (1A) and 29 of the 1955 Regulations, as amended by paragraph (1) of this Regulation, are set out in the Table to this Regulation.

TABLE.

5. (1A).—There shall be charged and paid in respect of every call made by a caller from a call office, in addition to the sum chargeable under paragraph (1) of this Regulation, a call office fee of 15p.

29.—If any subscription or any fee, charge, expense or damages payable by the subscriber under the agreement or under the other provisions of these Regulations is in arrear for fourteen days, excluding Sundays and public holidays, after the relative account has been rendered, or the subscriber has failed to offer such security as may be required by the Minister in accordance with Regulation 17, the Minister may, without notice, and without prejudice to the terms of the agreement or to the provisions of these Regulations, suspend service on the installation or disconnect the installation from the telex exchange and may make in respect of any restoration of service after suspension or disconnection under the terms of this Regulation a charge of 46.5p to be payable on demand.
