THE LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) ACT, 1963, (EXEMPTED DEVELOPMENT) (AMENDMENT) REGULATIONS, 1976

The Minister for Local Government in exercise of the powers conferred on him by sections 4 and 10 of the Local Government (Planning and Development) Act, 1963 , (No. 28 of 1963), hereby makes the following regulations:

1. These Regulations may be cited as the Local Government (Planning and Development) Act, 1963 , (Exempted Development) (Amendment) Regulations, 1976.

2. The Local Government (Planning and Development) Act, 1963 (Exempted Development) Regulations, 1967 ( S.I. No. 176 of 1967 ), are hereby amended as follows:

( a ) by the insertion in sub-paragraph (vi) of paragraph (a) of sub-article (5) of article 3 after "class" of "19A, 19B or", and

( b ) by the insertion in Column 1 of Part I of the Schedule before class 20 of the following:

"CLASS 19A

The carrying out pursuant to and in accordance with a consent given by the Minister for Transport and Power under section 8 of the Gas Act, 1976 (No. 30 of 1976) by the Irish Gas Board of development consisting of the construction of underground pipelines for the transmission of gas (but not the construction or erection of any apparatus, equipment or other thing ancillary to such a pipeline save cathodic protection equipment and marker posts).

CLASS 19B

The carrying out in accordance with requirements of the Minister for Transport and Power under section 40 of the Gas Act, 1976 , of development consisting of the construction of an underground pipeline for the transmission of gas (but not the construction or erection of any apparatus, equipment or other thing ancillary to such a apparatus, save cathodic protection equipment and marker posts).".

EXPLANATORY NOTE.

These Regulations amend the Local Government (Planning and Development) Act, 1963 (Exempted Development) Regulations, 1967, so as to provide for exemption from planning control in respect of the construction of certain underground gas pipelines and limited ancillary facilities.
