S.I. No. 205 of 1976.

PERIOD OF APPRENTICESHIP AMENDMENT ORDER, 1976.

AN CHOMHAIRLE OILIÚNA in exercise of the powers conferred on it by Section 49 of the Industrial Training Act, 1967 (No. 5 of 1967) hereby makes the following Order:

1. This Order may be cited as the Period of Apprenticeship Amendment Order, 1976.

2. (1) Rule 4 of the Apprenticeship Act (Trade of Motor Mechanic) (Period of Apprenticeship) Rules, 1964, is hereby amended by—

( a ) the substitution of "four years" for "five years", and

( b ) the substitution of "of six months" for "not exceeding three) months" in paragraph (i), and

( c ) the substitution for paragraph (v) thereof of the following paragraph:

"(v) Notwithstanding the provisions of this rule a person entering on employment as an apprentice who obtains at least Grade D in four subjects in the Leaving Certificate examination of the Department of Education or Grade D or an equivalent rating in four subjects in any examination adjudged by An Chomhairle Oiliúna to be at least the equivalent standard of the Leaving Certificate examination shall serve an apprenticeship period of three years."

(2) Rule 4 of the Apprenticeship Act (Trade of Electrician) (Period of Apprenticeship) Rules, 1964, is hereby amended by—

( a ) the substitution of "four years" for "5 years", and

( b ) the substitution of "of six months" for "not exceeding 6 months" in paragraph (i), and

( c ) the substitution for paragraph (iv) thereof of the following paragraph:

"(iv) Where an apprentice is, through illness or other reason, absent from employment for a total period in excess of six weeks in any one year ending on the anniversary of the date of commencement of his period of apprenticeship that particular year of apprenticeship shall be extended by such excess period;" and

( d ) the substitution for paragraphs (v) and (vi) thereof of the following paragraph:

"(v) Notwithstanding the provisions of this rule a person entering on employment as an apprentice who obtains at least Grade D in four subjects in the Leaving Certificate examination of the Department of Education or Grade D or an equivalent rating in four subjects in any examination adjudged by An Chomhairle Oiliúna to be at least the equivalent standard of the Leaving Certificate examination shall serve an apprenticeship period of three years."

(3) Rule 4 of the Apprenticeship Act (Engineering and Metal Trade) (Period of Apprenticeship) Rules, 1964, is hereby amended by—

( a ) the substitution of "four years" for "5 years", and

( b ) the substitution of "of" for "not exceeding" in paragraph (i), and

( c ) the substitution for paragraph (iv) thereof of the following paragraph:

"(iv) Where an apprentice is, through illness or other reason, absent from employment for a total period in excess of six weeks in any one year ending on the anniversary of the date of commencement of his period of apprenticeship that particular year of apprenticeship shall be extended by such excess period;" and

( d ) the substitution for paragraph (v) thereof of the following paragraph:

"(v) Notwithstanding the provisions of this rule a person entering on employment as an apprentice who obtains at least Grade D in four subjects in the Leaving Certificate examination of the Department of Education or Grade D or an equivalent rating in four subjects in any examination adjudged by An Chomhairle Oiliúna to be at least the equivalent standard of the Leaving Certificate examination shall serve an apprenticeship period of three years."

(4) The Apprenticeship Act (Furniture Trade) (Period of Apprenticeship) Rules, 1964, are hereby amended by the substitution for Rule 4 thereof of the following rule:

"4. The period of apprenticeship in the furniture trade shall be four years, except as hereinafter provided, that is to say:—

(i) an employer may employ an apprentice for a probationary period of six months,

(ii) where an apprentice is retained after the completion of the probationary period as an apprentice the probationary period shall be included in the period of apprenticeship specified above,

(iii) all other rules made under the Act in relation to the furniture trade shall apply in relation to the probationary period,

(iv) where an apprentice is, through illness or other reason, absent from employment for a total period in excess of six weeks in any one year ending on the anniversary of the date of commencement of his period of apprenticeship that particular year of apprenticeship shall be extended by such excess period,

(v) Notwithstanding the provisions of this rule a person entering on employment as an apprentice who obtains at least Grade D in four subjects in the Leaving Certificate examination of the Department of Education or Grade D or an equivalent rating in four subjects in any examination adjudged by An Chomhairle Oiliúna to be at least the equivalent standard of the Leaving Certificate examination shall serve an apprenticeship period of three years."

(5) Rule 4 of the Apprenticeship Act (Trade of Building and Construction) (Period of Apprenticeship) Rules, 1966 is hereby amended by—

( a ) the substitution of "four years" for "five years", and

( b ) the substitution of "of" for "not exceeding" in paragraph (i), and

( c ) the deletion in paragraph (iv) of "continuously" and the substitution of "total period in excess of six weeks in any one year ending on the anniversary of the date of commencement of his period of apprenticeship that particular year" for "period in excess of six weeks, the appropriate year of his employment by way" in the said paragraph (iv), and

( d ) the substitution for paragraph (v) thereof of the following paragraph:—

"(v) Notwithstanding the provisions of this rule a person entering on employment as an apprentice who obtains at least Grade D in four subjects in the Leaving Certificate examination of the Department of Education or Grade D or an equivalent rating in four subjects in any examination adjudged by An Chomhairle Oiliúna to be at least the equivalent standard of the Leaving Certificate examination shall serve an apprenticeship period of three years."

(6) Rule 4 of the Apprenticeship Act (Printing Trade) (Period of Apprenticeship) Rules, 1967, is hereby amended by—

( a ) the substitution of "The period of Apprenticeship in the printing trade shall be four years except as hereinafter provided, that is to say:" for "The period of Apprenticeship in the printing trade shall be as follows:

— from 24th February, 1967, the period agreed by the employer and the apprentice or six years, whichever is the shorter,

— from 1st January, 1968, five years, except as hereinafter provided, that is to say;" and

( b ) the substitution of "of six months" for "not exceeding three months" in paragraph (i), and

( c ) the deletion in paragraph (iv) of "continuously" and the substitution of "total period in excess of six weeks in any one year ending on the anniversary of the date of commencement of his period of apprenticeship that particular year" for "period in excess of four weeks, the appropriate year of his employment by way" in the said paragraph (iv), and

( d ) the substitution for paragraph (v) thereof of the following paragraph:—

"(v) Notwithstanding the provisions of this rule a person entering on employment as an apprentice who obtains at least Grade D in four subjects in the Leaving Certificate examination of the Department of Education or Grade D or an equivalent rating in four subjects in any examination adjudged by An Chomhairle Oiliúna to be at least the equivalent standard of the Leaving Certificate examination shall serve an apprenticeship period of three years."

(7) Rule 4 of the Apprenticeship Act (Trade of Dental Craftsman) (Period of Apprenticeship) Rules, 1966 is hereby amended by—

( a ) the substitution of "four years" for "5 years", and

( b ) the deletion in paragraph (iv) of "continuously" and the substitution of "total period in excess of six weeks in any one year ending on the anniversary of the date of commencement of his period of apprenticeship that particular year" for "period in excess of six weeks, the appropriate year of his employment by way" in the said paragraph (iv), and

( c ) the substitution for paragraph (v) thereof of the following paragraph:—

"(v) Notwithstanding the provisions of this rule a person entering on employment as an apprentice who obtains at least Grade D in four subjects in the Leaving Certificate examination of the Department of Education or Grade D or an equivalent rating in four subjects in any examination adjudged by An Chomhairle Oiliúna to be at least the equivalent standard of the Leaving Certificate examination shall serve an apprenticeship period of three years."

3. This Order shall come into operation on the 1st day of September, 1976, and shall apply only to persons entering on employment as apprentices on or after that date.

EXPLANATORY NOTE.

An Chomhairle Oiliúna (The Industrial Training Authority) was established under the Industrial Training Act, 1967 , to promote training in industry and commerce.

This Order amends the Period of Apprenticeship Rules by reducing the period of apprenticeship to four years; and providing for a three year apprenticeship in certain cases.
