ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF TIPPERARY SOUTH RIDING) REGULATIONS, 1976.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations: —

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Tipperary South Riding) Regulations, 1976.

2 Commencement.

2. These Regulations shall come into operation on the 30th day of August, 1976.

3 Interpretation.

3. In these Regulations save where the context otherwise requires

"the Act" means the Road Traffic Act, 1961 ;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town:

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. The Road Traffic (Speed Limits) (County of Tipperary South Riding) Regulations, 1968 ( S.I. No. 214 of 1968 ) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Carrick-on-Suir:

( a ) Tinvane or Kilonerry Boreen between the Urban District boundary and a point 68 metres north of its junction with the Waterford (North) Road.

( b ) The Glebower Road for a distance of 250 metres from the Urban District boundary.

( c ) The Ballyrichard Road for a distance of 795 metres from the Urban District boundary.

( d ) The Cregg Road for a distance of 800 metres from the Urban District boundary.

( e ) The Waterford (North) Road for a distance of 1,045 metres from the Urban District boundary.

( f ) The Waterford (South) or Tramore Road between the Urban District boundary and a point 706 metres south-east of its junction with Dillon Bridge.

( g ) The main Dungarvan Road for a distance of 290 metres from the Urban District boundary.

( h ) The Mothel Road for a distance of 135 metres from the Urban District boundary.

( i ) The Coolnamuck Road for a distance of 969 metres from the Urban District boundary.

( j ) The Clonmel Road for a distance of 455 metres from the Urban District boundary.

2. The following roads in the Urban District of Cashel:—

( a ) The Clonmel Road where the said road is a perimeter road.

( b ) The Dublin Road for a distance of 155 metres from the Urban District boundary.

( c ) Crotty's Lane for a distance of 224 metres from the Urban District boundary.

3. The following roads in the Borough of Clonmel:

( a ) St. Patrick's Road for a distance of 182 metres from the Borough boundary.

( b ) The Haywood Road for a distance of 233 metres from the Borough boundary.

( c ) The road leading from Haywood Road to Glenconnor Cottages.

( d ) The Dublin or Waterford Road between the Borough boundary and a point 571 metres south-west of its junction with Silver Spring Road.

( e ) The Cahir Road between the Borough boundary and a point 91 metres north-west of its junction with the Marlfield Road.

4. The following roads in the town of Fethard:

( a ) The Cloneen Road for a distance of 251 metres from the town boundary.

( b ) The Rosegreen or Redcity Road for a distance of 182 metres from the point where the town boundary intersects the southern side of the road.

( c ) The Cashel Road between the town boundary and a point 201 metres from the point where the said boundary intersects the western side of the road.

( d ) The Rocklow Road where the said road is a perimeter road.

5. The following roads in the Urban District of Tipperary:—

( a ) The Cahir Road for a distance of 91 metres from the point where the Urban District boundary intersects the northern side of the road.

( b ) The Scalaheen Road for a distance of 109 metres from the Urban District boundary.

( c ) The perimeter road connecting the Galbally Road with Old Barracks Road between its junction with the Galbally Road and a point 131 metres north east of its junction with the Scalaheen Road.

( d ) The Galbally Road for a distance of 246 metres from the Urban District boundary.

( e ) The Emly Road for a distance of 457 metres from the point where the Urban District boundary intersects the southern side of the road.

( f ) The Limerick Road for a distance of 93 metres from the Urban District boundary.

( g ) The Bohercrow Road for a distance of 329 metres from the Urban District boundary.

( h ) The Murgasty Road for a distance of 192 metres from the point where the Urban District boundary intersects the eastern side of the road.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ardfinnan:

( a ) The Terrace, Factory Hill Road, St. Finnan's Avenue.

( b ) The Goatenbridge Road between its junction with the Clonmel-Mitchelstown road and a point 234 metres north of its junction with the Lacken Road.

( c ) The Clonmel-Mitchelstown road between a point 475 metres north-east of its junction with the Marlhill Road and a point 92 metres north-west of its junction with the Goatenbridge Road.

( d ) The Newcastle Road for a distance of 23 metres from its junction with the Clonmel-Mitchelstown road.

( e ) The Ardfinnan-Cahir road between its junction with the Clonmel-Mitchelstown road and a point 204 metres north-west of its junction with the Factory Hill Road.

( f ) The road at Mount Carmel connecting the Clonmel-Mitchelstown road with Goatenbridge Road.

( g ) The Monroe West Road for a distance of 23 metres from its junction with the Goatenbridge Road.

( h ) The Ballyhickey Road for a distance of 45 metres from its junction with the Ardfinnan-Cahir road.

( i ) The Marlhill Road for a distance of 45 metres from its junction with the Clonmel-Mitchelstown road.

( j ) The Priest's Road between its junction with the Goatenbridge Road and a point 55 metres south-east of its junction with the Clonmel-Mitchelstown road (at Castleview Cross).

( k ) The road connecting the Factory Hill Road to the Ardfinnan-Cahir road.

2. The following roads at Ballingarry:

( a ) The Killenaule-Harley Park road between a point 740 metres north-west of its junction with The Commons Road and a point 420 metres south-east of the said junction.

( b ) The Commons Road for a distance of 500 metres from its junction with the Killenaule-Harley Park road.

( c ) The Lismalin Road for a distance of 110 metres from its junction with the Killenaule-Harley Park road.

3. The following roads at Ballyclerehan (Clerehan):—

( a ) The Clonmel-Cashel road between a point 275 metres east of its junction with the Newchapel Road and a point 156 metres north-west of the said junction.

( b ) The Cahir Road for a distance of 240 metres from its junction with the Clonmel-Cashel road.

( c ) The Newchapel Road for a distance of 155 metres from its junction with the Clonmel-Cashel road.

( d ) The road leading to the County Council Housing Scheme from the eastern side of the Newchapel Road.

4. The following roads at Ballynonty:

( a ) The Clonmel-Urlingford road between a point 105 metres south-west of its junction with the Ballingarry Road and a point 175 metres north-east of the said junction.

( b ) The Ballingarry Road for a distance of 70 metres from its junction with the Clonmel-Urlingford road.

( c ) The Lanespark Road for a distance of 210 metres from its junction with the Clonmel-Urlingford road.

( d ) The road leading to the County Council Housing Scheme from the eastern side of the Clonmel-Urlingford road.

5. The following roads at Ballyporeen:

( a ) The Clonmel-Mithelstown road between a point 247 metres east of its junction with the Burncourt Road and a point 366 metres west of the said junction.

( b ) The Carrigavisteal or Burncourt Road for a distance of 400 metres from its junction with the Clonmel-Mitchelstown road.

( c ) The Kiltankin Road for a distance of 195 metres from its junction with the Burncourt Road.

( d ) The Araglen Road for a distance of 220 metres from its junction with the Clonmel-Mitchelstown road.

6. The following roads at Ballysloe:

( a ) The Killenaule-Gortnahoe road between a point 320 metres south-west of its junction with the Grange Road and a point 90 metres north-east of the said junction.

( b ) The Grange Road for a distance of 130 metres from its junction with the Killenaule-Gortnahoe road.

7. The following roads at Bansha: —

( a ) The Tipperary-Cahir road between a point 55 metres north of its junction with the Aughnagower Road and a point 229 metres south of its junction with the Glen of Aherlow Road.

( b ) The Aughnagower Road for a distance of 65 metres from its junction with the Tipperary-Cahir road.

( c ) The Glen of Aherlow Road for a distance of 183 metres from its junction with the Tipperary-Cahir road.

All roads (other than (i) the Cork Road between a point 274 metres south-west of its junction with Barrack Street and a point 1,097 metres south-west of the said junction (ii) the Clonmel Road between a point 92 metres north-east of its junction with Market Street, and a point 716 metres north-east of the said junction and (iii) the Mountain Road between a point 686 metres west of its junction with Abbey Street and a point 796 metres west of the said junction) in the area enclosed by a line commencing at a point on the Dublin or Cashel Road 542 metres north of Railway Bridge and drawn thence in straight lines successively to the following points:—

( a ) a point on the Clonmel Road 716 metres north-east of its junction with Market Street,

( b ) a point on Pearse Street 137 metres south-east of its junction with Market Street,

11. The following roads adjacent to the Urban District of Cashel:

( a ) St. Oliver Plunkett's Park.

( b ) The Cahir Road where the said road is a perimeter road and for a distance of 135 metres south from the point where the boundary of the Urban District of Cashel intersects the eastern side of the road.

( c ) The Windmill Road for a distance of 45 metres from its junction with the Cahir Road.

12. The following roads at Clogheen:

( a ) Creamery Lane, Clogheen Market, Cockpit Lane, the Lios Mhuire Housing Scheme Road, Chapel Lane.

( b ) The Clonmel-Mitchelstown road between a point 229 metres south of its junction with the Cahir Road and a point 46 metres west of its westernmost junction with the Lios Mhuire Housing Scheme Road.

( c ) The Lismore Road between its junction with the Clonmel-Mitchelstown road and its junction with the Newcastle Road.

13. The following roads at Cloneen:

( a ) The Fethard-Mullinahone road between a point 105 metres west of its junction with the Killusty Road and a point 20 metres east of its junction with the Drangan Road.

( b ) The Killusty Road for a distance of 65 metres from its junction with the Fethard-Mullinahone road.

( c ) The Drangan Road for a distance of 50 metres from its junction with the Fethard-Mullinahone road.

14. The following roads adjacent to the Borough of Clonmel:

( a ) The Powerstown Road, the Old Fethard Road, the Western Road, Northfield Housing Estate Roads, Cherrymount Housing Estate Roads, Ardgaoithe Drive, Ardgaoithe Close, Ardgaoithe Avenue, Haywood Drive.

( b ) Tivoli Road for a distance of 370 metres from the boundary of the Borough of Clonmel.

( c ) The Fethard Road for a distance of 503 metres from the boundary of the Borough of Clonmel.

( d ) The Glenconnor Road where the said road is a perimeter road.

( e ) The Cashel Road for a distance of 168 metres from the boundary of the Borough of Clonmel.

15. The following roads at Commons:

( a ) Denis O'Sullivan Terrace.

( b ) The Ballingarry-Urlingford road between a point 355 metres south-east of its junction with the Garrynagree Road and a point 95 metres north-west of the said junction.

( c ) The Coalbrook Road for a distance of 125 metres from its junction with the Ballingarry-Urlingford road.

( d ) The Garrynagree Road for a distance of 270 metres from its junction with the Ballingarry-Urlingford road.

16. The following roads at Drangan:

( a ) The Lismoynan-Mullinahone road between a point 115 metres south-west of its junction with the Ballylusky Road and a point 225 metres east of its junction with the Newtown Road.

( b ) The Ballylusky Road for a distance of 245 metres from its junction with the Lismoynan-Mullinahone road.

( c ) The Newtown Road for a distance of 60 metres from its junction with the Lismoynan-Mullinahone road.

( d ) The Gortussa Road for a distance of 65 metres from its junction with the Thurles-Tipperary road.

( a ) The Clonmel-Cashel road between a point 335 metres south-east of its junction with the Newinn Road and a point 238 metres north-west of the said junction.

( b ) The Newinn Road for a distance of 46 metres from its junction with the Clonmel-Cashel road.

( c ) The Fethard Road for a distance of 37 metres from its junction with the Clonmel-Cashel road.

34. The following roads adjacent to the Urban District of Tipperary:

( a ) The Cashel Road for a distance of 229 metres from the boundary of the Urban District of Tipperary.

( b ) The Corroge Road for a distance of 42 metres from its junction with the Cashel Road.

( c ) The Boheranuisge Road and its continuation as the Dundrum Road between the point where the boundary of the Urban District of Tipperary intersects the eastern side of the Boheranuisge Road and a point 83 metres north of the junction of the Dundrum Road with the Carrownreddy Road.

( b ) The Tubrid Road for a distance of 55 metres from its junction with the Clonmel-Mitchelstown road.

( c ) The Kilcommon Road for a distance of 55 metres from its junction with the Clonmel-Mitchelstown road.

( d ) The Priest's Road for a distance of 55 metres from its junction with the Clonmel-Mitchelstown road.

2. The following roads at Cahir:

( a ) The Cork Road between a point 274 metres south-west of its junction with Barrack Street and a point 1,097 metres south-west of the said junction.

( a ) The Limerick-Tipperary road between a point 183 metres north-east of its junction with the Cullen Road and a point 138 metres south-east of the said junction.

( b ) The Cullen Road for a distance of 115 metres from its junction with the Limerick-Tipperary road.

( c ) The Monard Road for a distance of 101 metres from its junction with the Limerick-Tipperary road.

10. The following roads at New Birmingham:

( a ) The Clonmel-Urlingford road between a point 175 metres south-west of its junction with the Littleton-Coalbrook road and a point 385 metres north-east of the said junction.

( b ) The Coalbrook Road for a distance of 130 metres from its junction with the Clonmel-Urlingford road.

( c ) The Littleton Road for a distance of 65 metres from its junction with the Clonmel-Urlingford road.

11. The following roads at Newinn:

The Dublin-Cork road between a point 270 metres north of its junction with the Golden Road and a point 366 metres south of the said junction.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) Regulations, 1968, in their application to the County of Tipperary South Riding and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by Section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule for all mechanically propelled vehicles.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
