HOSPITALS COMMISSION (DISSOLUTION) ORDER, 1976.

The Minister for Health in exercise of the powers conferred on him by section 42 of the Health Act, 1970 (No. 1 of 1970) hereby orders as follows:—

1. This Order may be cited as the Hospitals Commission (Dissolution) Order, 1976.

2. This Order shall come into operation on the 1st day of April 1976, being the day on which the Hospitals Commission (hereinafter referred to as the Commission) is dissolved by virtue of the coming into operation of section 42 of the Health Act, 1970 .

3. All the property, rights and liabilities of the Commission are hereby transferred to the Eastern Health Board.

4. Any person who, immediately before the 1st day of April 1976, was the holder of an office under the Commission shall, on that day be transferred to a similar office under the Eastern Health Board.

5. All contracts of a continuing character and all contracts and agreements in writing made by or with the Commission and not fully executed and completed are hereby continued in force and shall have effect as if they had been made by or with the Eastern Health Board.

6. All legal proceedings pending at the suit of or against the Commission shall be continued in the name of the Eastern Health Board.

EXPLANATORY NOTE.

The effect of this Order is to transfer all the properties, rights, liabilities and staff of the Hospitals Commission to the Eastern Health Board consequent on the coming into operation of section 42 of the Health Act, 1970 under which the Hospitals Commission is dissolved. Section 42 is brought into operation by the Health Act, 1970 (Commencement) Order, 1976 ( S.I. No. 78 of 1976 ).
