HARBOUR RATES (WATERFORD PORT AND HARBOUR) ORDER, 1975.

I, PETER BARRY, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and after due compliance with section 106 of that Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Waterford Port and Harbour) Order, 1975.

(2) This Order shall come into operation on the 10th day of January, 1976.

2. The Waterford Harbour Act, 1919, shall be construed and have effect as if the rates specified in the Schedule to that Act (inserted by the Harbour Rates (Waterford Port and Harbour) Order, 1974 ( S.I. No. 374 of 1974 )), were increased by thirty three and one third per cent.

3. The Schedule to the Harbour Rates (Waterford Harbour) Order, 1954 ( S.I. No. 224 of 1954 ) inserted by the Harbour Rates (Waterford Port and Harbour) Order, 1972 ( S.I. No. 149 of 1972 )), is hereby amended by—

( a ) the substitution in the third column of that Schedule at reference number 1 for "14p", "18p" and "20p" (inserted by the Harbour Rates (Waterford Port and Harbour) Order, 1974), of "17.5p", "22.5p" and "25p", respectively,

( b ) the substitution in the second column of that Schedule at reference number 3 for "seventy tons" of "twenty-five tons" and in the third column of that Schedule at that reference number for "10p" of "15p", and

( c ) the substitution in the third column of that Schedule at reference number 5 for "2p" (inserted by the Harbour Rates (Waterford Port and Harbour) Order, 1974), of "3p".

EXPLANATORY NOTE

The effect of this Order is to authorise the Waterford Harbour Commissioners to charge revised maximum tonnage and goods rates.
